Kimley»>Horn <br />Page ' <br />Title <br />Western States will order one title commitment through a title company for up to one (1) parcel. <br />Valuation <br />A third -party appraisal and appraisal review for up to one (1) parcel is provided in the scope because the <br />property interest will be higher than $25,000. <br />Preparation of Documentation <br />WSLS will draft the initial Notice of Interest Letter and an Offer to Purchase letter that meet CDOT <br />standards. WSLS will use the CDOT MOA and standard City conveyance forms that will be filled out by our <br />staff and reviewed by the City prior to issuance. <br />Negotiations <br />Prior to starting the appraisal WSLS will issue the NOI letters and attempt to meet with the landowner and <br />the appraiser(s) to review the property. After the appraisal(s) are completed and a FMV is approved by the <br />City, WSLS will present an Offer on behalf of the City. Once the Offer has been issued, WSLS will discuss <br />the compensation being offered and obtain initial feedback. Throughout negotiations, WSLS will maintain <br />current communication with the City and Project Team regarding the status of the negotiations and any <br />issues that may arise. If determined that a voluntary settlement is unable to be negotiated, WSLS will <br />discuss remaining options with the Project Team. <br />Closings <br />Once an agreement is reached, the final documentation will be forwarded to the City for review and <br />approval. Upon acceptance of the executed Agreement WSLS will coordinate the closing through the title <br />company. If the City would like to obtain title insurance, they can purchase this directly from the title <br />company. <br />Condemnation <br />If it is determined that eminent domain is necessary, WSLS will be available to provide testimony as to their <br />good faith negotiations at an IP hearing. All acquisition efforts will meet and exceed the statutory <br />requirements for good faith negotiations. <br />Right of Way Clearance <br />Once the property has been acquired and closed WSLS will submit complete files to CDOT requesting <br />ROW Clearance. Once clearance is received WSLS will consider their efforts to be complete. <br />Task 1.13.8 Alternative Delivery Method Evaluation <br />It is understood that the City desires to consider an Alternative Project Delivery Method (e.g. Design -Build, <br />Construction Manager/General Contractor) for the project and evaluate the benefits in comparison to <br />traditional Design -Bid Build. Kimley-Horn will support the City in consideration and evaluation of delivery <br />methods for the project.
