According to Section 17.36, non-conforming uses <br />may continue in perpetuity, as long as the use does not cease to exist for more than one <br />(1) year. This property has not ceased to be used as a single family residence for more <br />than one (1) year. <br />The land use table permits one unit for every 1,750 square feet of lot area. This property <br />is approximately 8,522 square feet in area, which would permit a total of 4 units. In <br />discussing the proposal with the Chief Building Official, Mike Jones, he stated the <br />International Building Code (IBC) requires a structure to include sprinklers if there are 3 <br />or more units. Because of this requirement, the applicant is only willing to include one <br />additional unit so as not to trigger the need for sprinklers. <br />Also, according to the land use table, multi-family residential uses are permitted in the <br />CN zone district as a use by Special Review. Although the City of Louisville recently <br />approved an administrative SRU process, this project does not comply with the criteria <br />established for an administrative SRU due to the degree of additional square footage <br />(more than 200 square feet). <br />Site Plan <br />Existing- the existing structure is located near the center of the site.
