While Amendment 41 prohibits gifts or other items <br />of value greater than $50 in alny calendar year, the Code of Ethics sets a $15 <br />threshold. Where Amendment 41 prohibits gifts and certain activities based on <br />the status of the covered person's affiliation with government, Louisville's Code <br />of Ethics prohibits specific conduct based on its effect on and relationship to the <br />operations of the Louisville government. <br /> <br />City Attorney Light recommended the City Council adopt Resolution No. 15, <br />Series 2007, which affirms the applicability of the Code of Ethics in lieu of <br />Amendment 41. He explained Amendment 41 does not apply to Home Rule <br />municipalities, which have a Gode of ethics in place and noted Resolution No. 15, <br />Series 2007, is much clearer than Amendment 41. He stated state law provides <br />for rules for gifts to independE~nt contractors and matters other than contracts. If <br />Council desires to expand the code of ethics provision to independent <br />contractors, they may direct Staff to prepare an ordinance to expressly extend its <br />gift rules to include independent contractors. <br /> <br />There was Council consensus on direction to the City Attorney to investigate <br />extending gift rules to independent contractors. <br /> <br />MOTION: Council member Sackett moved to approve Resolution No. 15, Series <br />2007, seconded by Council member Muckle. All in favor. Absent: Mayor Pro <br />Tern Brown. <br /> <br />ORDINANCE No. 1513, SERIES 2007 - AN ORDINANCE AMENDING <br />CERTAIN SECTIONS OF TITLES 16 AND 17 OF THE lOUISVlllE <br />MUNICIPAL CODE CONCERNING CITY COUNCil REVIEW OF <br />PRELIMINARY SUBDIVISION PLATS AND PRELIMINARY DEVELOPMENT <br />PLANS _1st r1eading - set public hearing 3/20/07 <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1513, Series 2007 and presented a <br />summary of the current code. Ordinance No. 1513, Series 2007 repeals the <br />appeal process and the call-up of a development provision. <br /> <br />MOTION: Mayor Sisk moved to approve Ordinance No. 1513, Series 2007 on <br />first reading, send it out for plUblication, and set a public hearing for March 20, <br />2007, seconded by Council member Clabots.
