<br />City Council <br />Meeting Minutes <br />February 20, 2007 <br />Page 9 of 11 <br /> <br />reported on the annual International Council of Shopping Centers convention, <br />which will be held May 20 - 2:3, in Las Vegas. The suggestion has been for the <br />Mayor, the Interim City Mana~)er, and Ms. Hogan to attend the conference. At the <br />conference, appointments would be set with a mix of existing retail currently <br />doing business in Louisville, als well as interested developers looking at doing <br />future retail business in the City. <br /> <br />Mayor Sisk reported on a meeting he and Interim City Manager Balser attended <br />with Lakewood Officials where the International Council of Shopping Centers <br />conference was discussed. He stressed the conference would afford the City <br />opportunities to discuss economic development opportunities for the City of <br />Louisville. <br /> <br />RESOLUTION No. 15, SERIES 2007 - A RESOLUTION AFFIRMING THE <br />CITY'S CODE OF ETHICS ,AS CONTAINED IN THE CITY'S CHARTER AND <br />MUNICIPAL CODE <br /> <br />Mayor Sisk requested a Staff presentation. <br /> <br />Interim City Manager Balser Elxplained in November 2006 the Colorado voters <br />approved Amendment 41 , which adds a new Article XXIX to the Colorado <br />Constitution pertaining to ethics in government. The Amendment became <br />effective on December 31,2006, and establishes standards for ethical <br />considerations for elected and appointed officials, as well as employees and <br />independent contractors of loeal governments. The Amendment does not apply <br />to home rule municipalities that have adopted "charters, ordinances, or <br />resolutions that address the matters covered" by Amendment 41. <br /> <br />The immediate concern for Louisville, as a home rule city, is to consider action <br />affirming the applicability of the City's Code of Ethics in lieu of Amendment 41 , <br />and to discuss whether additions to the Code of Ethics are desired. Resolution <br />No. 15, Series 2007 affirms that Amendment 41 does not apply because the <br />City's Code of Ethics addresses matters covered by Amendment 41. <br /> <br />Louisville has adopted in its Charter and municipal code a comprehensive Code <br />of Ethics (first version adopted in 1992). Louisville's Code of Ethics provides <br />considerably more detail and guidance than Amendment 41 on ethical matters. <br />The Code of Ethics has much greater clarity with respect to enforcement, <br />determination of covered persons, and ethical standards. Main distinctions are <br />that the Code of Ethics gift ban provision does not expressly apply to <br />independent contractors and does not expressly extend to non-contract matters, <br />though receipt of gifts in connection with exercise of non-contract functions is <br />clearly contrary to the spirit of the Code and is covered by other laws other than <br />Amendment 41. <br />
