Phare stated that the <br />City has a fifty-foot right-of-way, from 96th Street to 88th Street. He noted that the <br />County is joint property owner. <br /> <br />Sam Light, City Attorney, updated the Council on potential changes to the purchase <br />contract. In addition to increasing the right-of-way there will be an increase in the <br />earnest money payment from $10,000 to $50,000. With respect to the water well that <br />serves the residents now, the seller will retain the well. The provision of a long-term <br />lease agreement will be reached after closing. In addition, the provision for a three-year <br />agricultural agreement with two individuals has been deleted. <br /> <br />MOTION: Sisk moved that Council approve Resolution No. 26, Series 2000 - A <br />Resolution Approving a Purchase Contract to Buy and Sell Vacant Real Estate, Water <br />Rights and Conservation Easement, seconded by Keany. Roll call was taken. The <br />motion passed by a vote of 7-0. <br /> <br />ORDINANCE NO. 1335, SERIES 2000 - AN EMERGENCY ORDINANCE <br />AUTHORIZING THE PAYMENT OF CITY MONEYS FOR THE ACQUISITION <br />OF VACANT REAL ESTATE, WATER RIGHTS, AND A CONSERVATION <br />EASEMENT, FOR OPEN SPACE, CONSERVATION, AND RIGHT-OF-WAY <br />PURPOSES - BOWES PROPERTY, SE CORNER DILLON ROAD & 88TM <br />STREET - 2nd reading - public hearing (advertised in Daily Camera 04/08/00) <br /> <br />Davidson called for City Attorney introduction. <br /> <br />Sam Light, City Attorney read Ordinance No. 1335, Series 2000, An Emergency <br />Ordinance Authorizing the Payment of City Moneys for the Acquisition of Vacant Real <br />Estate, Water Rights, and a Conservation Easement, for Open Space, Conservation, and <br />Right-of-Way Purposes - Bowes Property, SE Comer Dillon Road & 88th Street. <br />Light stated that the Ordinance No. 1335, Series 2000 does include a proposed <br />amendment that this Ordinance is made an Emergency Ordinance. <br /> <br />Davidson opened the public hearing and asked if anyone in the audience wished to speak <br />for or against Ordinance No. 1335, Series 2000. Hearing none, Davidson closed the <br />public hearing. <br /> <br />Bill Simmons, City Administrator noted that $837,000 would come from Conservation <br />Trust-Land Acquisition Fund and $243,000 from Capital Projects (Right-of-Way) for the <br />total purchase price of $1,080,000. <br /> <br />5 <br /> <br /> <br />
