Louisville City Council Meeting <br />September 16, 2003 <br />Page 10 of 11 <br /> <br />Phare reported on the 96th Street Project and noted Agenda items for the October 7th <br />Council meeting: CDOT Agreement, Railroad Agreement, Construction Management <br />Service Contract for the Consulting Engineering, initial annexation documents for the <br />Mayhoffer parcel, and a possible recommendation of using under grounding funds for <br />power lines in conjunction with the overhead relocation. He reported the City is <br />continuing the right-of-way acquisition. To be consistent with the project schedule, the <br />Schreiter acquisition must be acquired, if necessary, through condemnation, by mid- <br />November. He reported the land trade with CTC for right-of-way acquisition has been <br />completed. He anticipated the County approving the deeds for the Warembourg Open <br />Space parcel right-of-way conveyance by September 25. He anticipated plans for bidders <br />to be ready next week. He noted a three-week bid process is required due to the scope <br />and complexity of the process. The bid opening would be October 14, and a possible bid <br />recommendation on October 21. City of Louisville, et al., Case No. 03CV1783, Boulder County District <br />Court, Division 1) <br /> <br />City Clerk Nancy Varra read Section 2.90.050 Public Statement, of the Louisville <br />Municipal Code, which governs topics that can be addressed at an executive session. <br /> <br />City Attorney Light reported that Executive Sessions are allowed under C.R.S. 24-6-402 <br />(4) (B). <br /> <br />MOTION: Davidson moved the Council convene in Executive Session to discuss <br />pending litigation and to consult with the City Attorney, seconded by Levihn. All in <br />favor.
