Louisville City Council Meeting <br />September 4, 2001 <br />Page 11 <br /> <br />Sisk amended his motion to include that the footprint size shall not exceed 3,500 SF. <br /> <br />Mayer accepted the amendment. <br /> <br />City Attorney Light questioned whether the conservation easement is a condition <br />precedent to annexation. He requested an amendment to the motion to change 16D, to <br />the extent that there is cash in-lieu for any portion of the land dedication, to include a <br />sentence "Any cash in-lieu payment shall be based on fair market value of the property at <br />the time of subdivision." <br /> <br />Sisk accepted the amendment and added the sentence "Said money shall be earmarked <br />and deposited in the open space fund." <br /> <br />Mayer accepted the amendments. <br /> <br />Brown stated his understanding that the payment for the trail would only be required if <br />the City proceeded with construction of the trail. <br /> <br />VOTE: Roll call vote was taken. The motion carried by a vote of 5-0. Davidson <br />excused, Howard absent. <br /> <br />MOTION: Brown moved that Council adopted Ordinance No. 1362, Series 2001, <br />seconded by Keany. <br /> <br />City Attorney Light commented that the Annexation Agreement is not signed. He asked <br />that Ordinance No. 1362 be approved on the condition that the Annexation Agreement be <br />executed and presented at the next City Council meeting. <br /> <br />Brown and Keany accepted the amendment. <br /> <br />VOTE: Roll call vote was taken. The motion carried by a vote of 5-0. Davidson <br />excused, Howard absent. <br /> <br />MOTION: Brown moved that council approve Ordinance No. 1363, Series 2001, <br />seconded by Keany. <br /> <br />Sisk offered a friendly amendment that the approval of Ordinance No. 1363, Series 2001 <br />be conditional upon a fully executed Annexation Agreement. <br /> <br />Brown and Keany accepted the amendment. <br /> <br />VOTE: Roll call vote was taken. The motion passed by a vote of 5-0. Davidson <br />excused, Howard absent. <br /> <br />11 <br /> <br /> <br />
