Louisville City Council Meeting <br />September 4, 2001 <br />Page 12 <br /> <br />Sisk welcomed the applicant to Louisville and thanked the Coal Creek residents for their <br />involvement in the process. <br /> <br />RESOLUTION NO. 45, SERIES 2001 - A RESOLUTION SUBMITTING A <br />BALLOT QUESTION ON A PROPOSED INITIATED ORDINANCE TO A VOTE <br />OF THE REGISTERED ELECTORS OF THE CITY OF LOUISVILLE AT THE <br />REGULAR ELECTION TO BE HELD NOVEMBER 6, 2001 (FISCHER <br />ANNEXATION PROPERTY) <br /> <br />Sisk called for Staff presentation. <br /> <br />City Attorney Sam Light stated that Resolution No. 45, Series 2001 will refer the initiated <br />ordinance to the voters at the November 6, 2001 election. The initiated ordinance <br />concerns the Fischer property. He reviewed that at the last meeting, Council designated <br />the City Clerk to set the ballot title. He noted that proceedings were held on August 22 <br />and 29, 2001, to fix the ballot title of the initiated ordinance. Resolution No. 45, Series <br />2001 would send the matter for the November 6, 2001 ballot. <br /> <br />City Clerk Nancy Varra reported that she conducted a proceeding on August 22, 2001 <br />and a protest was received on August 23, 2001. Mayor Davidson set the rehearing date <br />for August 29, 2001. Varra stated that a formal hearing was conducted on August 29, <br />2001, and was attended by the proponents of the initiated ordinance, after which the <br />ballot title was modified. She stated that the ballot title is now being presented to the <br />Council. <br /> <br />Sisk asked the City Clerk if she is recommending the ballot title. Varra responded yes. <br />The ballot title is as follows: <br /> <br />SHALL THE CITY OF LOUISVILLE ADOPT AN INITIATED ORDINANCE <br />REQUIRING THAT THE CITY USE ITS POWERS OF EMINENT DOMAIN TO <br />CONDEMN AND PURCHASE THE 7.6-ACRE FISCHER ANNEXATION <br />PROPERTY, EXCLUDING THE FISCHER HOMESTEAD OF NOT MORE THAN <br />THREE-QUARTERS OF AN ACRE, AND PAY THE OWNER OF SAID PROPERTY <br />1TS FAIR MARKET VALUE PURSUANT TO STATUTE, WITH THE EXCLUDED <br />HOMESTEAD AREA TO BE DESIGNATED BY THE OWNER OR BY THE CITY IF <br />THE OWNER FAILS TO DO SO, AND WITH THE PROPERTY TO BE DEDICATED <br />FOR USE AS A PARK OR OPEN SPACE AS DETERMINED BY THE CITY <br />COUNCIL? <br /> <br />Sisk asked for public comments. <br /> <br />Richard Kithil, 891 N.
