Case #07-0 14-PS/PP (Continued from <br /> <br />August 9,2007.) <br /> <br />. Applicant and Representative: RMCS, LLC (David Waldner) <br />. Owners: RMCS, LLC (David Waldner); Lockett E. Wood; W.D. Hamm; and Summit View Professional <br />Park, LLC (John Gstalder) <br />. Case Manager: Paul Wood, Planning Director <br /> <br />Conflict ofInterest and Disclosure: <br />Loo, Sheets disclosed they had used the dentistry practice located in the Summit View <br />Professional Park. Lipton stated his families association with the dentist that is part of the <br />development. Deborski and Loo disclosed their families had used Gstalder legal services for <br />some family matters. None of Commissioners felt that these contacts created a conflict of <br />interest. <br /> <br />Public Notice Verification: <br />Published in the Daily Camera on July 22, 2007. Posted in City Hall, Public Library, Recreation <br />Center and the Police and Courts Building and mailed to surrounding property owners on July <br />20,2007. The item was originally scheduled for the August 9,2007 public hearing and was <br />continued to this meeting. <br /> <br />Staff Report of Facts and Issues: <br />Wood summarized the staff report with the following points: <br />. The request is for an amendment to the GDP, a preliminary subdivision plat and <br />preliminary PUD for the Takoda Village Subdivision. <br />. Four property owners (RMCS, Wood and Lorenz, Hamm and Summit View <br />Professional Park, LLC) are represented by RMCS, LLC (Rick Brew, David Waldner <br />and Justin McClure). <br />. The subject parcel is located in northeast Louisville, east of the Burlington Northern <br />Santa Fe rail line, west ofHWY 42 and has approximately 700 feet of frontage on <br />HWY 42. <br /> <br />Wood continued with an overview of the Land Use Entitlements, housing types to be offered and <br />density, the planned areas of parks, trails and open space, the public-use dedication, traffic and <br />vehicle access, the 100-year regulatory floodplain. <br /> <br />Wood stated staff is requesting a continuance of the public hearing on the General Development <br />Plan, the preliminary subdivision plat and the preliminary PUD development plan to allow the <br />applicant to address the following fourteen (14) conditions: <br />1. The applicant shall provide for vehicular and utility access to the DellaCava / Tebo parcel <br />located to the west of this development. This access may be shown on the final <br />development plan submittal. <br />2. The applicant shall work with the City Attorney to ensure that all subdivision boundaries <br />and outlots are properly shown on the subdivision plat. <br />3. The applicant shall continue to work with CDOT to acquire approval for the access being <br />proposed on Parcel A to Highway 42. This access permit will be required at time ofFDP <br />submittal. <br />
