Louisville City Council Meeting
September 3, 2002
Page 4

Davidson called for Staff presentation.

Sisk recused himself from the discussion and vote of Ordinance No. 1398, Series 2002.
He explained that his wife is a member of the Avista Hospital Board of Directors.

Davidson asked that the record reflect that Council member Sisk was excused from the
discussions and vote of Ordinance No. 1398, Series 2002.

Principal Planner Ken Johnstone reviewed that Ordinance No. 1398, Series 2002
proposes to vacate a portion of the Health Park Drive as well as a series of utility and
drainage easements within the Health Park Subdivision. The applicant/owner is
requesting this action as the subject easements/right of way are not needed, or are being
relocated as they conflict with existing and or proposed structures. All new and relocated
utilities have been provided the necessary easements as dedicated on the Health Park
Subdivision, Filing No. 6. Johnstone reported the Planning Commission held a public
hearing on July 9, 2002 and forwards a recommendation of support for the vacation of
said easements and right of way.

Davidson opened the public hearing and asked if anyone in the audience wished to speak
for or against Ordinance No. 1398, Series 2002. Hearing none, Davidson closed the
public hearing.

MOTION: Brown moved that Council approve Ordinance No. 1398, Series 2002,
seconded by Levihn. Roll call vote was taken. The motion passed by a vote of 6-0. Sisk
excused.

RESOLUTION NO. 30, SERIES 2002 - AMENDED PUD DEVELOPMENT PLAN
FOR THE CENTURY RETAIL CENTER TO AUTHORIZE ATLANTA BREAD
COMPANY INSTALLATION OF A WALL SIGN,
321 S. MCCASLIN BLVD. LOUISVILLE

Davidson called for Staff presentation.

Principal Planner Ken Johnstone reviewed the requested PUD amendment, which
pertains to a wall sign immediate south of the main drive entry for identification of
Atlanta Bread Bakery and Caf& The proposed sign is to be installed on an eligible wall
above the window of the Dairy Queen store on the northwest comer of the building,
located at 321 McCaslin Blvd. He explained that the wall is eligible, however, not
proposed for the eligible business, as Atlanta Bread does not front McCaslin Blvd. He
noted that Dairy Queen and the building owner, O'Connor Development support Atlanta
Bread's request for the sign. He stated that other than location, the sign would be
CDDSG compliant. The sign is proposed to be approximately 2 feet high by 13 feet long,
or 26 square feet in size. The request includes that the sign be illuminated.

4
