<br />Bill Simmons, City Administrator, stated that his comments would be on both items, Resolution No. <br />19 and Ordinance No. 1211. He explained that this resolution and ordinance would give the City <br />the flexibility to consider under different standards of annexations of land on which land development <br />is not proposed soon after annexation. <br /> <br />Davidson called for Council comments or questions. <br /> <br />Mayer asked if this would supersede the open space dedication and completely allow the Council to <br />do that simply by resolution. <br /> <br />Susan Griffiths, City Attorney, stated that this did not apply to the subdivision process. <br /> <br />Sisk asked if the terms of the resolution consistent with some of the other neighboring cities. <br /> <br />Simmons stated that it was. <br /> <br />Sisk moved that Council approve Resolution No. 19, Series 1996. Seconded by Lathrop. All in <br />favor with Howard being absent. <br /> <br />b. ORDINANCE NO. 1211, SERIES 1996 - ALLOWING THE LOUISVILLE <br />CITY COUNCIL TO WAIVE OR DEFER CERTAIN ANNEXATION <br />REQUIREMENTS WHICH ARE NOT REQUIRED BY STA TE LAW <br /> <br />Griffiths read by title only Ordinance No. 1211, Series 1996, "An Ordinance allowing the Louisville <br />City Council to waive or defer certain annexation requirements which are not required by State law." <br /> <br />Davidson called for Council comment, questions, or motions. <br /> <br />Mayer felt if any dedications were required by the subdivision ordinance that Council be allowed to <br />defer until the subdivision occurs. <br /> <br />Sisk explained that this is subject to a subdivision agreement which would be worked out between <br />City Council, staff, and the developer. <br /> <br />Lathrop fully supported the ordinance. <br /> <br />Sisk moved that Council approve Ordinance No. 1211, Series 1996, at first reading, set it out for <br />public hearing at the next Council meeting with the amendments that there would be a two week <br />public notice that would be given by way of an ordinance for any modification, so the public could <br /> <br />8 <br />
