Planning <br />Director Russ explained it would include a Council member and specific stakeholders in <br />the corridor. There will be a special session with Council to identify the stakeholders as <br />this is a requirement of the Charter. <br />Phase 2: Discovery — Work Plan <br />Process: <br />- Technical Studies (Existing Conditions): <br />Existing Land use and Zoning Capacity Analysis <br />Multi -Modal Transportation Assessment <br />Corridor Character Assessment <br />- Project Steering Committee Review <br />Projects: <br />- Baseline Conditions <br />COUNCIL QUESTION <br />Council member Lipton asked if the zoning is changed through the small area plan, <br />what happens to the property rights of the owners and how are they be compensated. <br />Planning Director Russ explained there is a specific due process and the City will work <br />through the property rights and the constitutional rights. The property owners will be <br />invited to participate in the discussion. <br />City Attorney Light explained the legal principals are very succinct. Colorado law <br />provides there is a legitimate right to rely on current zoning. It takes into account how <br />the property has been used and the actual regulatory change being made. He will <br />provide additional information to the City Council. <br />Council member Lipton stated when considering the process, shouldn't the boundaries <br />be included, in terms of where it may lead and should lead. In the Comprehensive Plan <br />process, two areas were separated, which required more study. Were those two areas <br />treated differently than the rest of the areas in the Comprehensive Plan in terms of <br />contemplating changes to the zoning. <br />
