City Council
Meeting Minutes
July 1,2014
Mayor Muckle addressed the Boulder Valley School District (BVSD) projections of how
the 55 Townhome development would affect enrollment at LES. Principal Planner
McCartney stated the BVSD initial analysis was they would be able to serve those
children in the 72 townhome units.
Mayor Muckle felt the fiscal analysis was based on other numbers and asked if there is
an amended fiscal analysis. Planning and Building Safety Director Russ responded no
and explained the townhomes will generate fewer people per unit, but the actual
equation has not been determined for the decreased request.
Council member Stolzmann had studied the financial analysis and stated on average,
the price of the homes and the amount spent in town will lower sales and property taxes
a small amount.
Council member Lipton asked for the changes between the Preliminary and the Final
Plats. Principal Planner McCartney explained the Preliminary for this development was
72 townhome units and had alley access. The Final includes 55 townhome units and
still has alley access. Planning and Building Safety Director Russ explained in Phase 1
there is a donut hole for a potential five units to come in Phase 2.
Council member Lipton inquired about the width of the streets. Principal Planner
McCartney explained the setbacks on the alleys were modified to improve fire access
on the alleys, but the streets were not widened.
Council member Stolzmann referred to the mixed use standard guidelines, which
address the intent of the architectural variety. The intent is to avoid bleak, barrack -type
appearance associated with large concentrations of identical or similar structure. She
did not mind the modern style, but was opposed to the repetitive look. She agreed it
would be helpful to have the Planning Commission minutes on PUD's and the minutes
of the LRC meetings when the urban renewal area is involved and the design guidelines
and copies of the referral letters.
MOTION: Council member Lipton moved to approve Resolution No. 33, Series 2014,
with the modification to Condition #3, the developer "should" submit an Art Master Plan
in Phase 2 (instead of "shall "), with a 6th condition to read "the developer shall improve
the architecture transition from Little Italy to the proposed townhomes", seconded by
Mayor Pro Tem Dalton.
Mayor Muckle noted the public must be given the opportunity to speak again. He
requested the motion and second be withdrawn. City Attorney Light explained with
respect to ordinances, the Charter does require the public have an opportunity to speak
again a second time before action is taken. With resolutions, it is the Mayor's
prerogative to allow the public an opportunity to speak a second time.
