He then requested that Peter Stewart make a presentation as his <br />representative. <br /> <br />Peter Stewart, 1132 Jefferson Ave., discussed the following points: <br /> <br />1)The memo from CDOT regarding the Highway 42 ROW states they need 106’ when in <br />fact they already have 110’. <br /> <br />2)When the site visits were made to other sites it appears that some of the areas had the <br />impound area counted as parking and in some it did not count toward the parking ratio. <br /> <br />3)He also pointed out discrepancies in the type of sites. He feels that some of the sites <br />visited are mixed use instead of single use sites as referenced in the staff report. <br /> <br />4)He calculates the site parking for the front of the building at 4 / 1000 SF. <br /> <br />Commission Questions for Applicant: <br />Chairman Lipton called for questions from the Commissioners. <br /> <br />Commissioner Deborski directed his questions to Staff: 1) why was the original PUD for auto <br />body use and 2) could the new approval of the SRU have a time limit attached to it? Johnstone <br />replied that the auto body use for the original PUD was a legal use of the current zoning. As for <br />the time limits on an SRU, Staff would need to consult with legal counsel to determine if it could <br />be done. <br /> <br />Commissioner Pritchard asked how the applicant plans to maintain the lift and what kinds of <br />guarantees can the applicant provide that it will be maintained and operational. Fordyce <br />explained that the lift can be either purchased or leased and he prefers to own and to provide his <br />own maintenance on the lift. <br /> <br />Commissioner Pritchard asked the applicant if he had any concerns with the conditions. Fordyce <br />replied that he had no problems with the conditions. <br /> <br />Commissioner Deborski inquired of the cost for the lift. Fordyce stated that each 3-stage will <br />cost approximately $7,000 with a total investment of $35,000. <br /> <br />Commissioners Lipton, McDermott, Loo and McAvinew had no questions. <br /> <br />Members of the Public: <br />Chairman Lipton asked for comment from the public that had come to speak. None heard. <br /> <br />Staff Summary and Recommendation: <br />Chairman Lipton asked for Staff and Applicant for a summary and recommendation. <br /> <br />Johnstone had no additional information. <br /> <br />Fordyce asked what he could do to get the City to complete the street project that is a condition <br />of approval.
