<br /> <br /> <br />4.In conjunction with the Final PUD/SRU review, the applicant shall combine the two lots <br />into one legal lot, thus eliminating any question of parking and access agreements for any <br />future uses; <br /> <br />5.A note should be added to the PUD/SRU plans stating that the applicant agrees to <br />equitably participate in the financing and/or construction of Highway 42 public street <br />improvements, including but not limited to lane widening, curb and gutter, sidewalks, <br />bike lanes, streetlights, street signals, street trees and the burying of overhead dry <br />utilities. While it may not be appropriate for this property owner to pay for all of those <br />improvements (half an arterial street standard), we do believe that they should be required <br />to pay their reasonable share; <br /> <br />6.The Final PUD/SRU Site Plan should be modified to reflect a physical barrier to limit <br />vehicular access onto Highway 42 from Cannon Circle to right-in/right-out turning <br />options. The design of this barrier shall be subject to Public Works Department review <br />and approval and shall be constructed at the applicant’s expense; <br /> <br />7.The final PUD/SRU plan submittal should include an updated Final Grading and <br />Drainage Report accommodating the City’s full requirements for on-site storm water <br />detention; <br /> <br />8.A note shall be added to the Final PUD/SRU Site Plan that states, “Drainage facilities <br />shall be maintained by the applicant, including but not limited to detention ponds, outlet <br />structures, piping, etc.”; <br /> <br />9.The applicant shall also be aware that in the future, Cannon Circle Road improvements <br />will be reviewed and improvement costs may be assessed to the property owners who are <br />located along this road frontage; <br /> <br />10.It should be noted on the final PUD plans that the applicant / owner shall be required to <br />complete Cannon Circle public street improvements, as required in the applicant’s <br />previous development agreement with the City. Improvements should be completed no <br />later than the issuance of Certificates of Occupancy for any new or expanded building(s) <br />on the site, subject to Public Works Department plan review and approval, inspection and <br />construction acceptance practices; <br /> <br />11.The applicant / owner shall be required to maintain an operable parking lift system for 10 <br />above grade parking spaces. <br /> <br />Commissioner McAvinew seconded the motion. <br /> <br />Chairman Lipton called for a roll call vote. <br /> <br />Roll Call Vote: <br />Tom McAvinew, Yes; Michael Deborski, Yes; Susan Loo, Yes; Bill McDermott, Yes; Chris <br />Pritchard, Yes; and Jeff Lipton, Yes.
