Sheri Levine, 1005 Spruce Street, Boulder, Colorado, stated that she is hoping the coffee shop, The <br />Two Raccoons, will grow into a restaurant. It will be old world/old style. She wanted to feature <br />her brother's wine from the Grand River Vineyards in Palisade, Colorado, when the restaurant got <br />bigger. She will have primarily a vegetarian cuisine. <br /> <br />Davidson opened the public hearing calling for anyone wishing to speak on Ordinance No. 1175. <br />Tim Camps, personal representative for the estate of Rosanna Camps, was in favor of this project. <br />Davidson called for anyone else wishing to speak. <br /> <br />NONE <br /> <br />Davidson closed the public heating and called for Council comments or questions. <br /> <br />Mayer questioned the parking. <br /> <br />Hartronfi stated that parking in the central business district is not required to be provided by property <br />owners. <br /> <br />Davidson stated that the Lease amount should be $1.00/year. <br /> <br />Tami Tanoue, Griffiths & Tanoue, stated that in Paragraph 2, Page 1, the blanks would be filled in <br />as follows, "The term of this lease shall be ten (10) years commencing on January 17, 1995, and <br />terminating at midnight on January 16, 2004 .... " <br /> <br />Sisk wondered who would own the property. <br /> <br />Levine stated that she would own the property and Two Raccoons would lease it from her. <br /> <br />Sisk wanted that indicated in Paragraph 16, allowing that sub-lease. <br /> <br />Howard moved that Council adopt Ordinance No. 1175, Series 1995, on second and final reading for <br />a lease agreement on 641 Main Street to Shed S. Levine and Two Raccoons, as amended with the <br />lease amount being $1.00/year payable February 1 of each year. Seconded by Mayer. <br /> <br />Tanoue clarified that there would be two revisions to the Lease: 1. The lease term as described <br />previously; 2. Paragraph 3, "In consideration for this lease, Lessee shall pay the city the total amount <br />of $10.00 payable in ten increments of $1.00 per year." She did not know if a payment date would <br />need to be specified. She stated there would also be a revision to Paragraph 16 by removing the <br />period at the end of the second sentence, changed it to a semi-colon, with language along these lines <br />following," .... except that a sub-lease, transfer, or assignment from Lessee to Two Raccoons is hereby <br />approved, so long as Lessee is the majority shareholder in Two Raccoons, Inc." <br /> <br />4 <br /> <br /> <br />
