assignment agreement states that the new corporate indide Coal <br />Creek Golf Course Inc. wall under take the operation of the food <br />and beverage operations, it will assume all the corporate <br />responsibilities and contractual responsibilities pursuant to the <br />personnel services management agreement, however, RSL will <br />continue to be primarily responsible underneath that agreement <br />and will service as the guarantor of the new corporation. Your <br />city attorney has reviewed this agreement. <br />Williams stated that the agreement with RSL does provide that we <br />have to approve in writing any assignment so this is our approval <br />of assigning food and beverage operation to the new corporation. <br />Mayor Fauson asked if anyone would like to speak in favor or in <br />opposition to this proposal? None. <br />Szymanski moved and Davidson seconded to approve the assignment. <br />By Roll Call Vote motion passed 4-0. <br />Madsen stated that the application itself is straight forward. <br />Under the optional premises license it allows the sale of <br />alcoholic beverage at the club house and also off the beverage <br />cart which will travel around the entire 18 hole golf course. <br />Also included in the packet is what is titled an addendum to the <br />liquor license application which answers standards that is set <br />forth in the emergency ordinance which was adopted by this <br />council on April 3. <br />Williams stated that all proper notices and posting as required <br />by law have been accomplished. As evidenced by the matters <br />presented, and the prior proceedings before the council <br />pertaining to the golf course, which are incorporated herein by <br />reference, the granting of the license will meet the reasonable <br />requirements of the neighborhood for the type of license <br />requested; and the granting of the license is in the best <br />interest of the adult inhabitants of the neighborhood. No other <br />similar types of license: exist at or near the neighborhood under <br />consideration and the applicant has complied with the <br />restrictions under the code for an optional premises license. <br />Mayor Fauson asked if there was anyone that would like to speak <br />in favor of or in opposition to this proposal? None <br />Hornbostel moved <br />attorney and that <br />Course, seconded <br />passed 4-0. <br />OTHER <br />to inc~~rporate the suggestions of the city <br />we apj~rave the liquor license far the Golf <br />by Mayor Fauson.
