Susan Griffiths, City Attorney, stated that this ordinance is intended to increase the amount of
property damage from one to $400 to increase the jurisdiction of the Municipal Court over property
damage from one to $400 consistent with the change in state law.

Davidson called for Council comments, questions, or motions.

Sisk moved that Council approve Ordinance No. 1207, Series 1995, at first reading, set it out for
publication, and set a public hearing for December 5, 1995. Seconded by Mayer. All in favor with
Keany being absent.

RESOLUTION NO. 64, SERIES 1995 - FINAL PUD DEVELOPMENT PLAN, CITY
MOVING & STORAGE, COLORADO TECHNICAL CENTER, LOT 10, BLOCK 1

Paul Wood, Planning Director, stated that the property is approximately one acre and they are
requesting to construct a 10,090 s.f. building consisting of warehouse and office space. They
proposed 15 parking spaces, including one handicap space. They proposed a 5' high wood screen
fence adjacent to the parking and loading area along Arthur Avenue to provide additional screening
of the truck parking and loading area. Staff recommended that the fence elevation be reversed,
presenting the fence railing to the interior of the site. There would be one 3' x 6' sign. No outdoor
storage was shown or proposed. On November 14, 1995, Planning Commission approved the
request 6 - 0 with a condition that lighting details be added to the PUD. Resolution No. 64 contained
two conditions: That the fence elevation be reversed, presenting the fence railing to the interior of
the site and that the PUD be revised to reflect light fixture detail to insure that light is down directed.

Davidson pointed out that Councilman Howard had arrived.

Davidson called for the applicant's presentation.

Robert Borg, Robert Borg Associates, architects for the project, felt they would not have a problem
meeting the conditions.

Davidson called for public comments.

Richard Frame, 33 South Boulder Circle, #316, Boulder, Colorado 80303, property owner in the
Colorado Tech Center, was concerned about truck traffic and the storage of trailers or debris on the
property.

Davidson called for Council questions.

Mayer asked if trailers would be stored on site.

Borg stated that at any one time there might be a couple of tractor/trailer type vehicles in the parking
lot. The trucks will be parked deep into the lot. All storage will be done internally.

4
