Susan Griffiths, City Attorney, stated that there are two <br />typographical errors that need to be corrected prior to <br />publication. In Section 1 (a), the word "that" in the second line <br />should be "than". In Section 1 (b), the word "know" in the third <br />line should be "known". <br /> <br />Davidson: <br /> <br />Howard, I assume you're <br />that in your motion. <br /> <br />Howard and seconder, Hornbostel, agreed. <br /> <br />including <br /> <br />Roll call was taken. Motion passed by a 7-0 vote. <br /> <br />EXECUTIVE SESSION <br /> <br />Susan Griffiths, City Attorney, stated that the attorney that has <br />been representing the City in the litigation titled "Campbell vs. <br />City of Louisville, et al" has provided to the City a document and <br />some comments that should be addressed initially in an Executive <br />Session. She asked the Council to go into Executive Session for <br />the purpose of discussing a matter of pending litigation. <br />Specifically, the lawsuit of Campbell vs. City of Louisville, et <br />al. <br /> <br />Maj-Lis Kemper, City Clerk, read the statement concerning executive <br />sessions (SEE ATTACHED). <br /> <br />Hornbostel moved for Council to go into Executive Session to <br />discuss pending litigation on the Campbell vs. City of Louisville, <br />et al. Seconded by Howard. All in favor. <br /> <br />RETURNED FROM EXECUTIVE SESSION <br /> <br />Davidson called the meeting back to order. <br /> <br />Susan Griffiths, City Attorney, stated that while in Executive <br />Session the Council discussed the matter of pending litigation, <br />Campbell vs. City of Louisville, et al. She explained that the <br />City has been provided a proposed settlement agreement by its <br />Defense Council, Bernard Sapp, of the law firm of Cooper & Kelly. <br />Sapp has recommended that the Council execute the agreement on <br />behalf of the City. Griffiths stated that she agrees with Mr. <br />Sapp's recommendation and recommended to Council that the agreement <br />be approved. She had one suggestion for revision to the agreement: <br />Throughout the agreement the City Board of Adjustment is improperly <br />referred to as the Board of Appeals and Zoning Adjustments. She <br />had a series of very minor revisions, to make sure that the Board <br />is referred to properly as the Board of Adjustment. <br /> <br />Sisk stated that based upon the advice of the defense council <br />provided to the City of Louisville by the City's insurance company <br />and based upon the City Attorney's advice, he moved that Council <br /> <br />7 <br /> <br /> <br />
