unclear from the documents that we
were given, exactly what the
sidewalk plan is for CTC. I don't
know that there was any intent to
bind anybody to anything other than
that at such time as sidewalks were
put, each property owner would be
obliged to put in the sidewalks
themselves.

Davidson called for Council comments and/or questions.

NONE

Howard moved that Council approve Resolution No. 15, Series 1993,
Final PUD Development Plan for the Boulder Sausage Company with the
added conditions of the Planning Commissions. Seconded by Mayer.

Lathrop stated that if this applicant would agree to install their
sidewalk at such time as there is a synergistic plan that's
approved by the City for the CTC, or at least this segment of CTC,
then he thinks it would make some sense that this applicant agree
to install their sidewalk at that time, which Lathrop offered as a
friendly amendment.

Howard accepted that. Seconder, Mayer, accepted that.

Griffiths queried, for clarification, if Resolution No. 15, Series
1993, under Condition No. 1, should read "Sidewalk improvements
shall be installed at the expense of the property owner at the time
a sidewalk plan for CTC is approved by the City."

Lathrop: Correct.

Braun:

At what point does the
sidewalk get installed?

actual

Lathrop:

At the time a master sidewalk plan
is brought to the City and Council
approves it for the whole park.

Davidson suggested adding the words "development of the adjacent
property", because there is no reason to build a sidewalk that goes
nowhere, has to be maintained, and possibly be replaced in the
future. Davidson had an alternative suggestion of saying "when the
City directs."

Lathrop:

I don't think we'd approve a plan
until there is enough construction
and occupancy out there to warrant
it.

11
