Siple: Sisk: We would definitely be up a creek. We realize that Martin entered into this previous agreement and we haven't changed a thing here in the spirit of cooperation. We just wanted to go through with the same type of agreement, knowing that Martin had extensive negotiations. Given that type of premise, and I guess I've bought into that premise, what kind of cooperation can the City of Louisville expect in terms of the Lastoka/Harney property and the building of our ballfields, if we choose to build there? Siple: Definitely, you would receive cooperation. Lathrop felt that this was an opportunity for both parties to get together and share their concerns. Siple pointed out that they do have on-going drilling in the area and he asked that Council consider Garrity's license agreement at this meeting and take Siple's word that they will address the Lastoka/Harney problems in the future. Lathrop: I did that once with Martin and I don't wish to have to go back through and make it right again. Mayer: This is a revokable agreement. If we approved it tonight at the City's discretion, could we revoke it at any time, at our choice? Susan Griffiths, City Attorney, stated that the wording of the license agreement indicates that it's revokable by the City at any time with 30 days prior notice to Garrity. She stated that after they had constructed their pipeline in the area, it's much more difficult to go through the revocation process than it is the initial process. Davidson explained the tri-party purchase of the Harney/Lastoka property (138 acres) to Siple, for clarification, particularly the 22 acres on the southern end for a possible ballfield complex. Siple stated that they would do all that they could to stay out of the way of the ballfields.
