Linda Salas, Clerk to the Authority, stated that Hunt Kitchens, <br />Inc. had been operating under a temporary permit pending final <br />action on their application. The application included the reports <br />on the fingerprint checks performed by the CBI and FBI, as well as <br />responses to the FBI report on various notices. Notices of this <br />hearing were posted and published in accordance with state law. <br /> <br />Davidson moved that the complete application, as described by Ms. <br />Salas, be made part of the record of this Hearing. Seconded by <br />Howard. <br /> <br />Davidson asked, if anyone present objected to the motion. <br /> <br />NONE <br /> <br />Ail in favor. <br /> <br />Susan Griffiths, City Attorney, stated that in consideration of the <br />application filed by Hunt Kitchens, Inc., the City Council is <br />acting in a quasi-judicial capacity as the local licensing <br />authority under state law. The Authority's decision tonight must <br />be based on the evidence presented to it at the Hearing and the <br />legal requirements set out in state laws. Under state law on a <br />transfer of ownership, members of the Authority may consider only <br />the following: <br /> <br />1.) Whether the officers, directors, and stock holders owning <br /> more than 10% of the stock of Hunt Kitchens, Inc. are of <br /> good moral character. <br />2.) Whether the character, record, and reputation of the <br /> applicant is satisfactory to the Authority. <br /> <br />She stated that for determination as to the moral character, <br />record, and reputation of the applicant and it's officers, <br />directors, and stockholders is to be made as of the time <br />of the application and this Hearing. She explained that they may <br />take into account the CBI and FBI reports in making their decision. <br />If the Authority does so, they must also take into account <br />responses to the reports, including the written response, which is <br />part of the application, as well as any responses which may be <br />offered at this meeting. <br /> <br />Davidson asked if the applicant or a representative of the <br />applicant would please come forward and make their presentation to <br />the Authority. <br /> <br />David Lewis, Attorney for the applicant, 1400 Main Street, <br />Louisville, Colorado, stated that Jack Hunt is the 100% shareholder <br />of Hunt Kitchens, Inc. and an officer in the Corporation. The <br />other director involved is Mr. Hunt's wife, Judy. He stated that <br />the evidence they had to present is the seven letters of reference <br />that are in Council's packet, along with five additional letters <br /> <br />6 <br /> <br /> <br />
