Roll call was taken. e ORDINANCE NO. 1111, SERIES 1993 - ZONING CERTAIN REAL PROPERTY - STELMACH - 1ST READING - SET PUBLIC HEARING 7/20/93 Griffiths read by title only Ordinance No 1111, Series 1993, · "An ordinance zoning property annexed to the City of Louisville, known as the Stelmach annexation." Sisk: If we zoned this CB, my reading of the zoning is that the gasoline service stations can be there, not as a matter of right, but there is an "R" there. What I am proposing as part of this zoning is that we eliminate the fact that gasoline service stations are part of the CB zoning. Susan Griffiths, City Attorney, stated that the "R" stands for special review. It would be permitted only by special review. She stated that if Council wished to address this issue, perhaps it could be done in the annexation agreement to eliminate that from the uses in the district. Sisk wondered if it could be made part of the annexation agreement that there would be deletion of certain uses. Griffiths: Bresnehan: Sisk: You certainly can. You would need the consent of the property owner. You mentioned the convenience center. I would like to make that a matter of PUD. We're not going to do a parking garage though. My suggestion is that with Susan's suggestion that we look and see the uses very carefully, that any annexation that we would have as itemized and Council would understand exactly what the uses could be, as a matter of right. Bresnehan We have no problem .... I know there's like 20 items in there, of which some are highly unlikely and we're not intending. I don't have a problem with moving to the annexation agreement on those items. 11
