Mohr stated that Council would not want to <br />threaten the availability of water to anyone <br />within the City's corporate limits especially with <br />Homart having their infrastructure in place ready <br />to develop. "We do have an agreement (with <br />Superior) right now and if we are going to change <br />that agreement, I think we have to be very serious <br />about what our responsibilities are to our <br />citizens." <br />Belston stated that another thing that the Town of <br />Superior could offer to Louisville is the joint <br />expansion of facilities. <br />Anderson asked if anything has changed for the <br />City of Louisville since the time the original <br />Agreement was drafted that would prompt Louisville <br />to seek changes or be interested in dealing with <br />proposed changes at this time. <br />Hundley stated that the original Agreement was <br />entered into mutually by both parties with both <br />parties benefiting. Superior had a large part in <br />drafting that Agreement and was entered into with <br />considerable forethought. Hundley feels that the <br />amended agreement is a major rewrite of the <br />original Agreement:. <br />Referring to a statement by Ms. Belston regarding <br />a letter sent to t:he Mayor of Superior, Hundley <br />stated that after some initial discussions with <br />Superior late in 1986 when they were considering <br />the Rock Creek Ranch project, he indicated in this <br />letter that instead of having to rely on a large <br />project like this to achieve a water system, <br />there would seem t:o be other avenues for Superior <br />to pursue such as a Community Development Block <br />Grant. The fact ghat the Rock Creek Project has <br />been incorporated into the Town of Superior adds a <br />different dimension than was originally there, <br />Hundley stated, a:nd on the basis of what was <br />submitted, Hundle;~ advised Council that it doesn't <br />make any sense to entertain seriously the revised <br />agreement as it si~ands. If any alterations are <br />considered, they :>hould be marginal. <br />Anderson stated that he has a problem with getting <br />into a counter proposal mode when in fact <br />Louisville did not: solicit a proposal to begin <br />with. If there is a need for any changes, it <br />would have to be within the boundaries of <br />something that is possible. Anderson asked what <br />prompted Superior"s proposed amendment. <br />8 <br />
