Andrew Horton, 940 McKinley Ave., wanted to
comment specifically on the zoning of this
annexation. Horton is in favor of the annexation
and presented a petition letter signed by
residents in the area requesting zoning be
designated as RR as opposed to the RL requested
by the applicant.
Anderson asked if the building permits would be
issued from the City's "Other" allocation
category. Wanush stated that they would be.
Mayor Fauson moved that the public hearing be
closed and called for a motion.
Anderson moved that Ordinance #898 be adopted.
Scarpella seconded. By Roll Call Vote, Ordinance
#898 was adopted unanimously.
ORDINANCE #899 - ZONING REQUEST - WICaGETT LTD. -
PUBLIC HEARING Rautenstrau$ read by title only Ordinance #899,
"An Ordinance amending Title 17 of the Louisville
Municipal Code of the City of Louisville entitled
"Zoning" by zoning property of Approximately 2.49
acres owned by W.H.P., limited, annexed to the
City by Ordinance No. 898." Proof of publication
and notice of public hearing were established.
Mayor Fauson opened the public hearing.
Wanush explained that this zoning request is in
conjunction with the preceeding annexation
request. The request is for Residential Low
Density (RL) zoning which has a minimum lot area
of 7, 000 s.f. Planning Commission heard this
request at the public hearing on May 13, 1986.
Commission approved the annexation yet recommended
RE zoning rather than the requested RL zoning.
Nancy Blackburn, applicant representative,
reminded Council that this parcel will be under a
PUD and that Planning Commission and Council will
be reviewing the proposed development for review
at a later date and encouraged Council to consider
the RL zoning to allow the developer the maximum
flexibility.
Mike Carruthers, 941 Garfield Ave., spoke in
reference to the petition circulated showing that
90~ of the residents signing it agreed with either
RE or RR zoning allowing for an appropriate
transition from the RL zoning.
Susan Hart, 929 McKinley Ave., spoke to favor of
RR zoning to preserve the character of the area.
9
