directly to Spruce Street. Lot 7 fronts Pine Street with access by <br />an existing curb cut on Pine Street. Lots 2 and 3 access Spruce <br />Street via Outlot A. Outlot A is proposed as a 20' wide private <br />fire lane maintained by the owners of Lots 2 and 3. Outlot B is <br />th~: 15% land dedication. Planning Commission's recommendation was <br />that the subdivider be responsible for the maintenance of Outlot B. <br />At Planning Commission's public hearing on February 8, 1994, they <br />ap~,roved Resolution No. 3 by a vote of 7 - 0 with eight conditions <br />of approval (SEE ATTACHED). Conditions 4 - 8 have been completed <br />by the applicant. This Resolution No. 16 had three conditions of <br />ap~,roval (SEE ATTACHED). <br /> <br />Davidson called for the applicant's presentation. <br /> <br />Bok. Grolsch, representing applicant Terry Kristovich, stated <br />concerning Outlot B being maintained by the homeowner's <br />ass.ociation, that with an outlot of this size and there being no <br />homeowner's association, it didn't seem worthwhile to establish a <br />homeowner's association to maintain a xeriscaped piece of ground. <br />On the cost of developing Spruce Street, the public improvements <br />are estimated to be $160,000. He received an estimate of $231,000 <br />for the development of Spruce, which does not include the cost of <br />burying the utility lines currently along West Spruce Street, an <br />add.ed $30 - $40,000. He asked Council if they would be interested <br />in working with Public Works and pay half of the public improvement <br />cos.t for the City of Louisville and look for the recovery in future <br />development. <br /> <br />Davidson called for Council comments and questions. <br /> <br />Ho%'ard wanted some trees on Outlot B. He was reluctant to have <br />taxpayers money up-fronted for the West Spruce Street improvements. <br />He felt the burden of development should fall on the developer. <br /> <br />Lat.hrop felt the developer should be responsible for their <br />development and all associated costs thereof. <br /> <br />Mayer wondered about the on-site detention. <br /> <br />Tom Phare, Public Works Director, stated detention would be taken <br />care of within the project. It will discharge to Pine Street. <br /> <br />Gr¢.lsch stated Lot 6 would take care of any drainage. <br /> <br />Mayer wondered who would maintain the 20' landscape and drainage <br />easement. <br /> <br />Gr¢.lsch: <br /> <br />It will be the responsibility of the <br />homeowner to maintain. <br /> <br />Mayer wondered about the difficulties of a shared driveway. <br /> <br />8 <br /> <br /> <br />
