Dave Stahl, Homart Representative, asked to <br />address Council regarding this proposal. Stahl <br />related to Council the terms by which this <br />subdivision was annexed in 1979 through <br />negotiations between the City of Louisville and J <br />K Louisville Associates and Hanover Development <br />Company. This land was annexed in conjunction with <br />Suitts 1407 acres to the City of Louisville and <br />they jointly signed an annexation agreement <br />outlining specifics for land uses, i.e. number of <br />residential units that would be allowed on the <br />property, commercial square footages, office <br />square footages, etc. <br />Since then there have been several modifications <br />to the agreement including McStain's Master Plan <br />and Homart's rezoning plan and development <br />agreement. The amount of commercial development <br />that this area can support is based on those <br />figures and the original annexation agreement, as <br />well as traffic counts, according to Stahl. <br />Homart will be analyzing its position as to <br />whether McStain's proposal does adversely <br />impact Homart's development agreement and zoning <br />agreement completed on April 17, 1984, and if it <br />does, to what extent Homart must then commit to <br />fulfill its obligations with respect to the <br />development agreement. <br />Stahl: "Naturally none of these decisions will be <br />made until we go through the process, but I want <br />you to know, as you move through that process, we <br />will also be moving through there. I suspect <br />those decisions are unilateral." <br />W-470 REPRESENTATIVE <br />APPOINTMENT The City's administrative staff recommended that <br />Council appoint a representative to the W-470 Task <br />Force, but delay payment of its share until the <br />Task Force acts upon the requested <br />additions/modificaations. <br />The meeting dates and times were not available at <br />this time and concerned Mayor Meier as to the <br />availability of a Councilmember to attend. Also, <br />discussed was the necessity of policy decisions <br />and/or technical decisions. <br />It was ultimately decided that a Councilmember <br />should be appointed for policy decisions and if <br />technical input became necessary, staff would be <br />available to attend. <br />8 <br />
