Levihn wanted the proposed extension date of the temporary permit.

Wood recommended that it go only to the point that they can occupy the permanent greenhouse.

Keany wanted the signage and lighting standards maintained, since this is at a "gateway" to the city.

Howard was concerned with the drainage and that they did not exceed historic drainage. He was in
favor of extending the expiration of the temporary use permit, as long as it was understood that
further extensions would be contingent upon how much construction of these greenhouses occurs.

Sisk moved that Council forward the Preliminary Subdivision Plat and PUD Development Plan to the
Planning Commission with Council's comments and that the Temporary Use Permit be extended to
a date determined by staff. Seconded by Lathrop. Roll call was taken. Motion passed by a 6 - 0
vote with Davidson being absent.

OTHER REGULAR BUSINESS ARISING AFTER PREPARATION OF AGENDA

Howard called for other regular business arising after preparation of the Agenda.

Sisk advised Council that the sub-committee comprised of Levihn, Keany, and Sisk met with the
Water and City Attorneys regarding the attorney's fees through June 30, 1994. The money allocated
for the Water Attorney's fees for December 31, 1994, was $100,000. To date the City had expended
some $68,000, with the Marshall Lake transfer being over budget. The attorney's fees that will be
expended for the completion of the Marshall Lake transfer of water rights are estimated to be
between $50 - 100,000, which exceeds the budget amount. The City Attorney's bills are right on
budget, possibly ahead of budget.

Howard requested that when the sub-committee determines that the budget has been overdrawn, a
proposed new budget be drafted for consideration by the Finance Committee.

CITY ATTORNEY'S REPORT

Susan Gfifl]ths, City Attorney, stated that they had been in contact with the Douglas County Attorney
to get a copy of the Douglas County District Court decision on school impact fees, which will be
provided to Council.

CITY ADMINISTRATOR'S REPORT

NONE
