Section ~i would require an 18" setback from an <br />existing sidewalk, no encroachment into a public right-of-way, and no <br />encroachment into a vision clearance area. <br />Council directed staff to evaluate thE; feasibility of incorporating a process by <br />which a property owner would be able to request zoning relief from the <br />requirements of the ordinance through the Board of Adjustment. He explained <br />the parking and storing of recreational vehicles and trailers are currently <br />regulated by nine required criteria in Section 17.20.165 of the proposed <br />Ordinance. The majority of those criteria as they relate to moveable vehicles and <br />trailers are not amenable for review by the Board, as the Board's zoning powers <br />are structured to regulate yard and k~ulk requirements of permanent structures. <br />The one criterion reviewable by the (Board would be the requirement to maintain <br />a 5' setback from the rear lot line. The Board could utilize separate criteria to <br />review a variance request from the rear set back requirement. Given the <br />limitations of the Board to address the majority of the required criteria as <br />proposed in the Ordinance, the Council may choose to modify the criteria if seen <br />to be overly restrictive. <br />Staff recommended Council approvE; Ordinance No. 1537, Series 2008 with <br />second reading amendments. The Council may also direct the effective date of <br />the entire ordinance or specific sections of the ordinance be deferred as directed. <br />Planning Director Wood requested aan email received from Mr. Richard Simpson, <br />1560 Ridgeway Drive, be made a part of the record. Mr. Simpson opposed <br />delaying the adoption of the ordinance. Mayor Sisk stated the email would be <br />made part of the record. <br />Police Chief Bruce Goodman commented on the 18" setback from the sidewalk <br />creates a dual enforcement issue, which may be problematic. <br />PUBLIC COMMENT <br />Mary Ann Pollock, 834 Lincoln Aveniue, Louisville, CO asked how many people in <br />the City would be affected by the ordinance. She requested a grandfather clause <br />to permit existing RV and trailer owners to store their vehicles on their property. <br />Ian Karpel, 928 LaFarge Avenue, Louisville, CO thanked Council for considering <br />this issue. He reported his neighbors agree with an ordinance that would balance <br />the rights of property owners. Although he was not in favor of setbacks, he <br />supported a balance of property rights. <br />
