City Council <br />Meeting Minutes <br />July 1, 2008 <br />Page 5 of 11 <br />Howard Pollock, 834 Lincoln Avenuf:, Louisville, CO opposed the RV ordinance, <br />which also included storage of PODS, dumpsters, construction trailers, travel <br />trailers, and horse trailers. He urged Council to vote no on the ordinance. <br />Jerry Davis, 703 Lois Drive, Louisvillle, CO stated he owns a 44' RV, and if the <br />ordinance passes, he will have to make modification to his property, or sell his <br />motor home. He did not believe the City has an RV problem. He urged Council <br />to deny the ordinance <br />Teresa Peck, 1316 Franklin Avenue, Louisville, CO felt her property is her own <br />and what she does with it is her busliness. She disagreed with regulating RV's <br />and stated the City must be considerate of RV owner's who complied with the <br />requirements in order to keep their FtV. She urged Council to vote no. <br />COUNCIL COMMENT <br />Councilor Ron Sackett explained thE; reason he suggested the Board of <br />Adjustment conduct a review process was that a one size fits all law does not <br />work. He saw a need for some flexibility. <br />Mayor Pro Tem Marsella stated this ordinance represents a great deal of Staff <br />time and public input. She supported the 18" setback from sidewalks but not a <br />grandfather clause. <br />City Attorney Light explained the current criteria for the Board of Adjustment is for <br />permanent structures. He noted the: City is a home rule city and can draft criteria <br />for the Board of Adjustment's revie~nr. He noted the Council can consider second <br />reading amendments to the ordinance to provide a Board of Adjustment review. <br />Additionally, another ordinance could come forward to provide criteria for Board <br />of Adjustment to review requested RV variances. <br />Mayor Sisk felt the ordinance should be adopted this evening, but the compliance <br />deferred until October 1St. He did not support a grandfather clause. He <br />supported a Board of Adjustment crliteria evaluation. <br />City Attorney Light outlined the second reading amendments, including adding <br />criteria for a Board of Adjustment vairiance review, and Council consideration of a <br />relief measure. <br />Councilor Muckle supported the ordinance, but felt some criteria for relief be <br />established before the compliance date. <br />MOTION: Mayor Pro Tem Marsella moved to approve Ordinance No. 1537, <br />Series 2008, second amendment, and compliance date of October 1, 2008 <br />seconded by Mayor Sisk. <br />
