Discussion/Motion - Request for Transfer of Hotel & Restaurant License - <br />Outback/Denver Joint Venture to Outback/Denver-I, Limited Partnership, dgo/a Outback <br />Steakhouse #0616 Louisville - 988 Dillon Road. <br /> <br />Attorney Light stated that there had been a change of ownership. The license was previously held in the <br />name of Outback/Denver Joint Venture and is proposed to be held by Outback/Denver-I, Limited <br />Partnership, which is a different type of entity. Therefore, the renewal for the Joint Venture was denied <br />and they must file a request for Transfer of the Hotel & Restaurant License. <br /> <br />Light noted that there were some inconsistencies on the application and on the Individual History Record <br />for the manager, Mr. Joe Nuzzolillo. On the application, line 19, it states that Mr. Nuzzolillo has a 9% <br />interest and on his Individual History Record, it states he has a 10% ownership. <br /> <br />Light also noted Mr. Nuzzolillo's FBI fingerprinting report reflects he had been issued a summons for <br />Driving While Under the Influence (DWAI) on November 25, 1997, a that a Failure to Appear (FTA) on <br />that charge also appears on the record. <br /> <br />Light stated that the application can be approved subject to clarification of the percentage of manager <br />ownership and of the DWAI and FTA charge, as reported by the FBI fingerprint records check. <br /> <br />POLICE DEPARTMENT REPORT <br /> <br />A. Disturbance at Pine Street Junction. <br /> <br />A disturbance occurred at the Pine Street Junction on May 22, 1998, which consisted of two women <br />creating a disturbance outside of the premises. Sergeant Riggins stated that police officers spent over <br />six hours investigating the incident, including follow-up liquor law training. The police department <br />elected not to file any charges in this matter. <br /> <br />Chairperson leffers and the members of the Authority voiced there concern about the apparent lack of <br />control of the bar. There was considerable discussion relative to this matter. Different views were <br />expressed as to whether the Authority should write a very strongly worded warning letter to the <br />establishment, or set the matter for a Show Cause hearing. <br /> <br />Attorney Light reviewed the options available to the Authority. The Authority could take not action, or <br />write a warning letter. It could also consider a motion making a probable cause finding, setting a show <br /> <br />4 <br /> <br /> <br />
