Planning Commission <br />Meeting Minutes <br />April 10, 2008 <br />Page 9 of 13 <br />Russell expressed an interest in a continuance to discussion with McCartney the <br />floodplain concerns, to have a better understanding the fence waiver being requested <br />by the applicant, <br />Wood asked Lipton to address the Commission. Lipton granted. <br />Wood stated the ditch is not regulated under FEMA. The fence, per LMC is required to <br />be completely fence by a 6' privacy fence. He also stated staff would be willing to work <br />on the wording of any of the resolutions. <br />Loo stated her general support of the project but she still had concerns about fire and <br />traffic safety. She also acknowledged the project is an SRU sothe Commission can call <br />it up anytime if they have any concerns. <br />Lipton stated his support of the 6' fence as required by LMC. He is not interested in a <br />continuance. <br />Tengler stated the school has done a good job at their current location and believes <br />they will at the new location. Therefore, he supports the project. <br />Sheets stated her support of the project. She stated if anyone ever has concerns about <br />the school they should discussion with the Planning Department and the Planning <br />Commission. He stated her agreement with the 6' feet along the ditch; however she <br />would support a chain link fence aNbund the other sides of the play area. <br />Tengler moved and Loo seconded a motion to approve Resolution No. 6, Series 2008, a <br />request for a Special Review Use (SRU) to allow for the operation of a Montessori <br />school on a property located at 1501 Jefferson Avenue and zoned Residential Low <br />Density (RL) the five (5) conditions identified by staff. <br />Lipton discussed wording changes to the five conditions as follows: <br />1) Remove the words "Staff requires a". The condition would start with the word <br />Trash. <br />2) Remove the words "Staff recommends there be". The condition would start with <br />the word Additional. <br />3) Remove the words "Staff recommends". The condition would start with the word <br />The. Also, delete the second sentence. <br />4) Remove the words "Staff recommends". The condition would start with the word <br />The. Also, change the word should to must. <br />5) No changes. <br />Lipton requested an amendment to the motion and second. Amendment was accepted <br />by Russell and Loo. <br />Lipton then read the conditions as follows: <br />1) Trash/recycling area be constructed on the site that will adequately serve this <br />use <br />2) Additional staff parking placed on the existing concrete drive that is located near <br />the existing detached garage. <br />3) The applicant should place the 6 foot solid fence along the northern property line <br />to prohibit children from accessing the ditch. <br />4) The area must be signed for "pick up and drop off only" to allow for the western <br />side of Jefferson Avenue to remain free and clear for queuing. <br />
