City Council <br />Meeting Minutes <br />November 17, 2020 <br />Page 3 of 9 <br />REGULAR BUSINESS <br />ORDINANCE NO. 1802, SERIES 2020 — AN ORDINANCE AMENDING TITLE 17 OF <br />THE LOUISVILLE MUNICIPAL CODE TO ALLOW MOBILE FOOD COURTS — 2nd <br />READING, PUBLIC HEARING (advertised Daily Camera 10/25/20) <br />Mayor Stolzmann opened the public hearing and asked for any disclosures. There were <br />no disclosures. <br />Planner Ritchie stated the initial food truck regulations were adopted in 2014 and 2015 <br />and rewritten in 2017. The current regulations do not contemplate more permanent <br />settings for Mobile Food Courts. The Planning Commission discussed the ordinance and <br />recommends approval. This item relates to the next agenda item under consideration. <br />The ordinance includes the proposed definition: A commercial development where two or <br />more mobile retail food establishments, mobile food vehicles, mobile vending carts, or ice <br />cream vendors congregate to offer food or beverages for sale to the public and includes <br />customary outdoor areas for eating and drinking. Operations associated with a private <br />catered event or a city -permitted special event are not considered a mobile food court. <br />As proposed, the ordinance would allow mobile food courts with special review use (SRU) <br />approval in certain zone districts. It would not be permitted in residential or agricultural <br />zones. All existing regulations for tax licenses, public health certification, fire district <br />approval, and other operating requirements applicable to all food trucks must be followed. <br />The hours of operation and amplified music could be reduced or expanded through the <br />SRU approval and all activities must occur on private property. <br />This ordinance removes the requirement for consent of nearby restaurants for food trucks <br />to be located in a mobile food court. The SRU process allows for a hearing where nearby <br />restaurants would be notified and have the chance to speak to the request for this use so <br />close to their business. <br />Ritchie reviewed the additional standards for the site plan and the approval criteria noting <br />the SRU process can add additional modifications and conditions. <br />Staff recommends approval of the ordinance. <br />Public Comments — None. <br />Mayor Pro Tern Maloney asked if the requirement for restrooms would require building <br />new restrooms specific to the food court. Ritchie stated that could be up for discussion <br />with the applicant. They could be new or located in a nearby business. <br />
