City Council <br />Meeting Minutes <br />March 16, 2021 <br />Page 7 of 13 <br />STREET AND DILLON ROAD; A PORTION OF THE SW QUARTER OF SECTION 16, <br />TOWNSHIP 1 SOUTH, RANGE 69 WEST OF THE 6TH P.M. <br />Mayor Stolzmann introduced the item and asked for disclosures. There were no <br />disclosures. Mayor Stolzmann noted some additional comments came in since the packet <br />was published and they have been entered into the record and posted online. Mayor <br />Stolzmann opened the public hearing. <br />Senior Planner Ritchie reviewed the 51-acre site and its history. The most recent activity <br />for the site was the approval of the 2nd GDP Amendment in 2020. The site is currently <br />under contract by the applicant, United Properties. This application is for a final plat for <br />the entirety of the property with 4 lots, 2 parcels, and 2 outlots. She reviewed the uses <br />and phasing of the different lots and outlots. <br />She stated the land dedication will be met by a portion of land in the outlots and the <br />remainder will be a cash in lieu payment. The subdivision agreement and the 2018 <br />approvals set forth a partial deferral that would allow the cash in lieu payment. Those <br />payments would be due when the individual lots develop and set at the value at that time. <br />The PUD covers two of the four lots. It includes a 100,000 sf industrial building on Lot 1; <br />industrial uses are allowed by right on this property per the GDP amendment, however it <br />requires commercial architecture standards be met. This proposed design meets the <br />landscaping and the commercial architecture requirements. <br />Lot 2 is proposed for a convenience store and fueling station which requires approval of a <br />Special Review Use (SRU) and also must meet the commercial design standards. It <br />includes enhanced landscaping along 96t" Street. <br />A condition of the GDP amendment in 2020 was that the development exceed the best <br />practices for Dark Sky lighting. Staff finds the proposal meets that requirement. <br />The applicant is asking for waivers for lower landscaping coverage on the building <br />perimeter with additional landscaping added at the site entry areas. Staff supports this <br />request. The applicant is also asking for a waiver to the 20-foot on -center street trees for <br />the north -south private drive. They are proposing replacing the 16 street trees with 16 <br />trees along the eastern elevation near the trail corridor. Staff feels this improves the trail <br />experience and staff supports this request. <br />For the SRU for the convenience store and fueling station staff finds the proposal <br />consistent with the Rural Context area for auto -oriented uses and development patterns; <br />it contributes to economic prosperity of the City; the site design is compatible with the <br />surrounding areas; and no waivers are requested for this portion of the GDP; it also <br />meets all criteria in the LMC. <br />Staff recommends approval of the resolution without conditions. <br />
