City Council <br />Meeting Minutes <br />March 16, 2021 <br />Page 9 of 13 <br />Jay Keany, 1488 Wilson Place, stated this site has been slated for development for many <br />years; he supports the project. He thinks this proposal is a good one that will bring new <br />jobs to the City. He added he thinks this is a good location for a gas station as there is no <br />other options for gas on that side of town for people headed to Denver. <br />Mayor Stolzmann asked if the new traffic signal on 96t" street is required to be installed <br />prior to the gas station being built. Ritchie stated that as a part of the public improvements <br />the traffic signal will be required to be installed prior to the gas station getting its certificate <br />of occupancy so it could be constructed concurrently and be in place prior the gas station <br />opening. <br />Mayor Stolzmann stated she feels the industrial building meets the CDDSG requirements. <br />Mayor Stolzmann asked if a fast charging station would be included as a part of the <br />application for the gas station so the application is more consistent with the <br />Comprehensive Plan. Rhymer stated the plan does call for a charging station on the <br />industrial building site. They are not planning for one at the convenience station as the <br />fastest ones take at least 30 minutes and they don't feel that works for a convenience <br />store. <br />Mayor Stolzmann stated her interest in pursuing this as electric cars are the future. <br />Mayor Pro Tern Maloney noted this application meets the expectations of what was <br />previously set out in the preliminary PUD. <br />Councilmember Brown stated he did not think this application meets the special review <br />use criteria for the gas station. Specifically criteria one, as he does not feel the proposal is <br />consistent with the spirit of the Comprehensive Plan and its sustainability goals. <br />Councilmember Lipton asked City Attorney Kelly what kind of latitude the Council has to <br />impose additional requirements. City Attorney Kelly stated any conditions the Council <br />imposes must relate back to the criteria in the code. <br />Mayor Stolzmann stated she feels the application does not meet SRU criteria number one <br />and adding a fast charging station would make it more consistent with the Comprehensive <br />Plan and not contrary to the general welfare of the City and immediate neighborhood. <br />Also adding a fast charging station would lend to the economic stability of the City. <br />Councilmember Lipton stated the Council is required to apply our rules and laws; he <br />would feel more comfortable adding requirements if they were explicitly in the code or <br />design guidelines. As presented this is a good design and meets our requirements. <br />Councilmember Fahey agreed the application meets the code; she added that a charging <br />station would be a benefit to the long-term owner. <br />
