City Council <br />Meeting Minutes <br />August 31, 2021 <br />Page 9 of 14 <br />Councilmember Leh supported Councilmember Brown's suggestion <br />Councilmember Fahey stated she supported the condition as written as there are other <br />things in the conditions such as requiring electrification and EV charging station that will <br />get us to where we want to be on sustainability. <br />The consensus of the majority was to keep the condition as proposed. <br />Condition #4 The Public land dedication shall be increased to 83.7 acres of land with the <br />recently added 20.3 acres of publicly dedicated Open Space be located around the pond <br />in Parcel C and contiguous to currently identified Open Space in Parcel A. <br />Mayor Stolzmann asked to include "land intended to be open natural land to be zoned as <br />Open Space on dedication." <br />Councilmember Brown proposed requiring everything north of Disc Drive as open space. <br />Councilmember Leh stated he does not support everything north of Disc Drive as open <br />space but he does feel additional land should be dedicated as open space due to the <br />impact of this development. <br />Mayor Pro Tem Maloney stated the 83.7 acres currently proposed is a good compromise <br />and the area represents purposeful open space including the pond. He supports this. <br />Councilmember Dickinson stated that asking for 160 acres is probably not reasonable as <br />it is 52% of the property. 83 acres is 25% of the area and when you add the undeveloped <br />areas of the property that are not a part of the public dedication it is close to the 30%. He <br />stated he would like to get to 93 acres which would be about 30%. <br />Mayor Stolzmann supported 93 acres as it relates to the public dedication and impact on <br />the community. She would like to see the development clustered together south of Disc <br />Drive to keep the area north of Disc Drive undeveloped so as to keep this area feeling <br />rural like its rural designation. That would also make the land dedication meaningful and <br />protect the view corridor. Without that clustering and keeping the area north of Disc Drive <br />open she stated she can't support this condition. <br />Councilmember Brown agreed with Mayor Stolzmann that this would protect the area the <br />best. He suggested a proposal that no building be allowed north of Disc Drive. <br />Councilmember Lipton stated he doesn't think the Executive Order for 30% open spaces <br />applies to local land use decisions and it is a Federal Order and an intrusion on local land <br />use decisions. The municipal code requires 12% public land dedication and the applicant <br />is offering twice that. He is concerned about setting precedents for other property owners. <br />However, he is interested in clustering the building to optimize the undeveloped areas <br />and meet some of our other goals. <br />
