<br />CITY ATTORNEY'S REPORT <br />ORDINANCE #804 - CHILD CARE <br />ZONING - PUBLIC HEARING <br /> <br />Director of Community Develop- <br />ment John Rupp <br /> <br />Dennis Rosengarten, 6082 <br />Glencoe, Littleton <br /> <br />Councilwoman Morris <br /> <br />8/16/83 <br /> <br />Page -8- <br /> <br />Councilmembers had a copy of the ordinance; <br />Attorney Rautenstraus read it by title only <br />and certified proper publication. <br /> <br />Mayor Meier opened the public hearing and <br />Attorney Rautenstraus certified proper publi- <br />cation of the notice of public hearing, and <br />advised Council that amendments had been made <br />to the ordinance after first reading. <br /> <br />Stated that he did not have a presentation <br />at this time. The recommended changes by <br />Council had been made to the ordinance; recom- <br />mendation was for adoption. <br /> <br />Mayor Meier continued the public hearing <br />and asked if there was anyone in favor of <br />Ordinance #804 - none. Anyone in opposition <br />to Ordinance #804. <br /> <br />Stated that he represented LaPetite Academy <br />Day Care Center and wished clarification <br />regarding the definition of neighborhood and <br />family care centers and how that would effect <br />by definition if there was an enrollment of <br />more than 12 children. <br />Attorney Rautenstraus advised there would be <br />no effect. The ordinance was not amended by <br />any of the definitions with the respect to <br />child care centers, and did not amend the zoning <br />with respect to child care centers. The basic <br />intent of the ordinance was to cover family <br />care homes in situations where there was day <br />care in a residence. Also, added a neighbor- <br />hood child care center and a small child care <br />center in the definitions regarding smaller <br />centers than those Mr. Rosengarten inquired <br />about. <br /> <br />Mayor Meier continued the public hearing and <br />asked if there were any public questions <br />regarding Ordinance #804 - none. Council <br />comments and questions. <br /> <br />Inquired if there was a specific reason why <br />small child care centers were restricted from <br />the Office Zone rather than making that a <br />Special Review Use. <br />Attorney Rautenstraus advised - did not know <br />of a specific reason, except that an attempt <br />was made to limit sometimes as much as possible, <br />what is allowed in various zones. <br />
