50/50 Option - Deafeated 75/25 Option Approved CRUZ - WATER PURCHASE AGREE- MENT APPROVAL BOULDER COUNTY LAND - PURCHASE CONTRACT APPROVAL MESA POINT ACCESS Don Shonkwiler, 538 Ash Court 3/1/83 Page -15- Councilman Ferrera moved that the 50/50 option be authorized. Motion defeated due to a lack of a second. Councilman Fauson moved, Councilman Leary seconded that the 75/25 option for funding be approved. Question called for. All in favor. Motion carried unanimously. Councilmembers had a copy of the agreement for 8 shares of Coal Ridge Ditch Company water for $24,000.00. Request was authori- zation for the :Mayor and Clerk to sign the agreement. Councilman Cussen moved, Councilman Ferrera seconded that the Mayor and Clerk be author- ized to sign the Cruz Water Purchase Agree- ment. Question called for. All in favor. Motion carried unanimously. Councilmembers had a copy of the contract. Attorney Rautenstraus advised it had been approved by the Boulder County staff, the Boulder County Attorney, and the Boulder County Finance Official. While it is has not been approved by the Boulder County Commissioners he felt it was the basic in- tent have been referred to them. This con- tract was structured in the same manner as the Aquarius property with a payment schedule on a yearly basis and property is released to the City on a yearly basis, and the re- mainder of the property is leased to the City throughout the remainder of the contract. He then depicted on the map lot 9A which the City would acquire the first year and which they most desire. Councilman Leary moved, Councilman Cussen seconded that the Boulder County Land Pur- chase Contract be approved. Question called for. All in favor. Motion carried unanimously. Mr. Shonkwiler requested that council grant him an access and parking easement to correct an error at the time the land was originally deeded to the City.
