Motion defeated due <br />to a lack of a second. <br /> <br />Councilman Fauson moved, Councilman Leary <br />seconded that the 75/25 option for funding <br />be approved. Question called for. All in <br />favor. Motion carried unanimously. <br /> <br />Councilmembers had a copy of the agreement <br />for 8 shares of Coal Ridge Ditch Company <br />water for $24,000.00. Request was authori- <br />zation for the :Mayor and Clerk to sign the <br />agreement. <br /> <br />Councilman Cussen moved, Councilman Ferrera <br />seconded that the Mayor and Clerk be author- <br />ized to sign the Cruz Water Purchase Agree- <br />ment. Question called for. All in favor. <br />Motion carried unanimously. <br /> <br />Councilmembers had a copy of the contract. <br />Attorney Rautenstraus advised it had been <br />approved by the Boulder County staff, the <br />Boulder County Attorney, and the Boulder <br />County Finance Official. While it is has <br />not been approved by the Boulder County <br />Commissioners he felt it was the basic in- <br />tent have been referred to them. This con- <br />tract was structured in the same manner as <br />the Aquarius property with a payment schedule <br />on a yearly basis and property is released <br />to the City on a yearly basis, and the re- <br />mainder of the property is leased to the <br />City throughout the remainder of the contract. <br />He then depicted on the map lot 9A which the <br />City would acquire the first year and which <br />they most desire. <br /> <br />Councilman Leary moved, Councilman Cussen <br />seconded that the Boulder County Land Pur- <br />chase Contract be approved. Question called <br />for. All in favor. Motion carried unanimously. <br /> <br />Mr. Shonkwiler requested that council grant <br />him an access and parking easement to correct <br />an error at the time the land was originally <br />deeded to the City.
