<br />AUDIENCE COMMENTS <br /> <br />CITY ATTORNEY'S REPORT <br />ORDINANCE #779 - ZONING AMEND- <br />MENTS <br /> <br />ADOPTED <br /> <br />ORDINANCE #784 - PUBLIC <br />~OTICES <br /> <br />Councilman Leary <br /> <br />TABLED <br /> <br />2/1/83 <br /> <br />Page -3- <br /> <br />None <br /> <br />Attorney Rautenstraus read the ordinance <br />by title only on second reading and certified <br />proper publication. He advised that the <br />Ordinance had been amended on second reading <br />to provide the section that no members of <br />the Board of Adjustments could be current <br />members of the Planning Commission. Requestd <br />that if Council chose to adopt the ordinance <br />to do so as amended. <br /> <br />Councilwoman Morris moved, Councilman Fauson <br />seconded that Ordinance 11779 - Zoning Amend- <br />ments be adopted as amended. Roll call vote. <br />Fauson Yes <br />Meier Yes <br />Leary Yes <br />Ferrera Yes <br />Morris Yes <br />Cussen Yes <br />Motion carried unanimously. <br /> <br />Attorney Rautenstraus read the ordinance <br />by title only on first reading - council- <br />members had a copy of it. The request was <br />for publication. <br /> <br />Expressed concern with the wording of the <br />ordinance - suggested a requirement be added <br />that a subdivider is resPQusiblefor sending <br />out the notices-that he-must notify the <br />developer of the adjacent property. <br />Attorney Rautenstraus suggested - a party <br />developing contact other developers in the <br />area separately from the regular notices sent <br />out. He furthe:r advised this requirement <br />would also be placed in all future subdivision <br />agreements. <br />Director Rupp suggested by requiring the <br />developer to send out the notices is going <br />to make his salesmen much more accountable <br />to home buyers. <br />Councilman Leary suggested such notices be <br />given the home buyer at the time of the closing. <br /> <br />Councilman Leary moved, Councilman Fauson <br />seconded that Ordinance #784 - Public Notices <br />be tabled for rewording until next council <br />meeting. Question called for. All in favor. <br />Motion carried unanimously. <br />
