AUDIENCE COMMENTS CITY ATTORNEY'S REPORT ORDINANCE #779 - ZONING AMEND- MENTS ADOPTED ORDINANCE #784 - PUBLIC ~OTICES Councilman Leary TABLED 2/1/83 Page -3- None Attorney Rautenstraus read the ordinance by title only on second reading and certified proper publication. He advised that the Ordinance had been amended on second reading to provide the section that no members of the Board of Adjustments could be current members of the Planning Commission. Requestd that if Council chose to adopt the ordinance to do so as amended. Councilwoman Morris moved, Councilman Fauson seconded that Ordinance 11779 - Zoning Amend- ments be adopted as amended. Roll call vote. Fauson Yes Meier Yes Leary Yes Ferrera Yes Morris Yes Cussen Yes Motion carried unanimously. Attorney Rautenstraus read the ordinance by title only on first reading - council- members had a copy of it. The request was for publication. Expressed concern with the wording of the ordinance - suggested a requirement be added that a subdivider is resPQusiblefor sending out the notices-that he-must notify the developer of the adjacent property. Attorney Rautenstraus suggested - a party developing contact other developers in the area separately from the regular notices sent out. He furthe:r advised this requirement would also be placed in all future subdivision agreements. Director Rupp suggested by requiring the developer to send out the notices is going to make his salesmen much more accountable to home buyers. Councilman Leary suggested such notices be given the home buyer at the time of the closing. Councilman Leary moved, Councilman Fauson seconded that Ordinance #784 - Public Notices be tabled for rewording until next council meeting. Question called for. All in favor. Motion carried unanimously.
