<br />Councilman Cummings <br /> <br />Councilman Meier <br /> <br />DELETION OF SECTION 6.20.0l0C <br /> <br />Police Chief Leesman <br /> <br />4/21/81 <br /> <br />Page - 4 - <br /> <br />Attorney Joss advised this section had <br />been taken from the State Statutes and at <br />the request of the Police Dept. If they <br />stated the State Statutes it would require <br />offenders to go before Boulder County court, <br />whereas "livi th a city ordinance they would <br />be asked to appear in our municipal court. <br /> <br />Inquired about the Lyons Club which sells <br />fireworks - were they in violation. <br />Attorney Joss advised they were not. The <br />restrictions were for explosive devices, <br />i.e. cherry bombs, large roman candles, <br />etc. - small firecrackers, sparklers, and <br />small fountains were legal. <br /> <br />Referred to page 13 - Section 5.16.130 <br />Massage Parlor License Fees, and stated <br />it was his opinion this was prohibited. <br />because of usage, etc. <br />Attorney Joss advised State Statutes set <br />the license fee and the only change made <br />was clarification of the renewal fees. <br />Re then referred to page 14 - section <br />6.20.0l0(C) Keeping of Certain Animals <br />Prohibited and thought this section should <br />be deleted. <br />Attorney Joss advised that sections B & C <br />of this section had been in the Municipal <br />Code since 1953 and his only change was <br />to have the Code enforcement Officer desig- <br />nated as the officer to enforce this section. <br />Councilman Meier moved that this section <br />be deleted from Ordinance #718 and from <br />the existing l'1unicipal Code. Seconded by <br />Councilman Domenico. Question called for. <br />All in favor. Motion carried 5-0. <br /> <br />Referred to page 13 - section 6.04.020 <br />and inquired if it was prohibitive to have <br />dogs in the city parks? <br />Attorney Joss advised dogs were allowed in <br />city parks on a lease. <br />Chief Leesman then referred to section <br />5.16.070 Display of License (B) "Director <br />of Public Safety shall carry said identity <br />card at a.ll times while in or upon the licensed <br />premises. <br />
