Councilman Cummings Councilman Meier DELETION OF SECTION 6.20.0l0C Police Chief Leesman 4/21/81 Page - 4 - Attorney Joss advised this section had been taken from the State Statutes and at the request of the Police Dept. If they stated the State Statutes it would require offenders to go before Boulder County court, whereas "livi th a city ordinance they would be asked to appear in our municipal court. Inquired about the Lyons Club which sells fireworks - were they in violation. Attorney Joss advised they were not. The restrictions were for explosive devices, i.e. cherry bombs, large roman candles, etc. - small firecrackers, sparklers, and small fountains were legal. Referred to page 13 - Section 5.16.130 Massage Parlor License Fees, and stated it was his opinion this was prohibited. because of usage, etc. Attorney Joss advised State Statutes set the license fee and the only change made was clarification of the renewal fees. Re then referred to page 14 - section 6.20.0l0(C) Keeping of Certain Animals Prohibited and thought this section should be deleted. Attorney Joss advised that sections B & C of this section had been in the Municipal Code since 1953 and his only change was to have the Code enforcement Officer desig- nated as the officer to enforce this section. Councilman Meier moved that this section be deleted from Ordinance #718 and from the existing l'1unicipal Code. Seconded by Councilman Domenico. Question called for. All in favor. Motion carried 5-0. Referred to page 13 - section 6.04.020 and inquired if it was prohibitive to have dogs in the city parks? Attorney Joss advised dogs were allowed in city parks on a lease. Chief Leesman then referred to section 5.16.070 Display of License (B) "Director of Public Safety shall carry said identity card at a.ll times while in or upon the licensed premises.
