He noted that his <br />reason for the request was that he will <br />be given the Mountain States Video pole <br />contract if the City selects Jones Inter- <br />cable to service the area, which will <br />save about 6 months in work time. <br />He noted that Mountain States Video has <br />agreed to the transfer of the pole con- <br />tract, which is legal, however, the pre- <br />sent franchise must stay in force to <br />keep the pole contract active. <br /> <br />Councilman Caranci stated that he felt <br />that since 1971 there should have been <br />better communication and felt the ordinance <br />should be revoked. <br /> <br />Councilman Meier questioned whether tabling <br />this ordinance action would in some way <br />give Jones Intercable the upperhand since <br />they would already have a pole contract. <br />Mr. Wurl responded that he did not feel <br />that other companies would be concerned, <br />and if all the companies were very close <br />in the running, it may help Jones, depending <br />on when Louisville wants cable television. <br /> <br />Councilman Carnival asked if there can be <br />more then one contract awarded. Mr. Jones <br />stated that in order to get a pole contract <br />the company must first have a franchise <br />with a municipality. <br /> <br />Mayor Waschak closed the public hearing. <br />After discussion Councilman Caranci moved <br />that Ordinance No. 677 be adopted. Se- <br />conded by Councilman Fauson. Roll call. <br />Ayes: Caranci, Fauson. <br />Nos: Domenico, DelPizzo, Meier, Carnival. <br />Motion defeated. <br /> <br />Attorney Joss gave an opinion that the state <br />statutes do not reflect a specific time <br />frame to return this ordinance and therefore <br />could be brought up again at any time. <br /> <br />All members of Council had before them a <br />copy of Ordinance No. 678 for their review <br />and files. <br />Attorney Joss read Ordinance No. 678 on <br />first reading by title only. <br />Councilman DelPizzo moved that Ordinance <br />No. 678 be ordered published and a public <br />hearing be set for April 15, 1980. Seconded <br />by Councilman Caranci. Motion carried. 6-0 <br />
