TIMES 2/22/97)

Griffiths read by title only Ordinance No. 1250, Series 1997, "An ordinance to apply and contract
for beneficial use of water on behalf of the City of Louisville, Colorado, a municipal corporation,
and prescribing the items for application for an allocation of the right to use Colorado-Big
Thompson Project water to the City of Louisville by Northern Colorado Water Conservancy
District."

Tom Phare, Public Works Director, stated that this is a contract between the City of Louisville and
the Northern Colorado Water Conservancy District for utilization of CBT units, which are actively
being acquired.

Davidson opened the public heating and called for anyone wishing to speak on Ordinance No. 1250.

NONE

Davidson closed the public hearing and called for Council comments, questions, or motions.

Sisk moved that Council adopt Ordinance No. 1250, Series 1997, on second and final reading,
seconded by Lathrop. Roll call was taken. Motion passed by a 6 - 0 vote with Howard being absent.

RESOLUTION NO. 14, SERIES 1997 - APPROVING A FINAL PUD DEVELOPMENT
PLAN FOR NEODATA SERVICES, INC. - LOT 1, NEODATA SUBDIVISION

Paul Wood, Planning Director, stated that the proposed two-story expansion of the applicant's
administrative office facility on South Boulder Road would add a total of 52,400 sf. to the existing
91,035 sf. office building. Per direction of the Planning Commission, the number of spaces being
added had been reduced from 137 spaced to 114 for a total of 502 spaces, which is the minimum
code requirement. This revised PUD reflected compliance with all conditions of the Planning
Commission with the exception of the following: Limiting hours of lighting in the parking lot;
Revising non-emergency operation schedule for the auxiliary power generator; The applicant had
not confirmed with staff their intent with regard to installation of noise mitigation devises to the
generator. Planning Commission requested that the Council consider, as a recommendation, limiting
the number of employees on-site during the hours of 7 p.m. - 6 a.m. to limit potential negative
impacts to the adjoining neighborhoods. The property is zoned "O".

3
