<br />E. & F. INDUSTRIES CONT'D <br /> <br />MR. DOMENICO'S TESTIMONY <br /> <br />the City the right to require repairs that are <br />needed to bring any homes up to standard. <br />E. & F. Industries are interested in the prob- <br />lem and are not trying to "duck it". They <br />have spent a lot of time, money, and done ex- <br />tensive studies and presented all possible <br />information to Council. Perhaps the property <br />owners who have houses in like condition, as <br />Mr. Domenico's, should also help solve the <br />problem. Shouldn't they also be required to <br />fix up their homes and keep a window from <br />rattling? Isn't that going to help solve <br />the problem to some extent? Mr. Joss then <br />stated, our suggestion to Council is that <br />they set-up a rational basis, a rational set <br />of guidelines to deal with these two problems <br />_ ground vibration and noise. There is an <br />existing State Statute now on the books as <br />part of the 1973 Revised Statutes which sets <br />up regulations for noise abatement that is <br />allowable in industrial and light industrial <br />usage. It also allows the City any oppor- <br />tunity if they want to pass any ordinances <br />that may be more restrictive, but does not <br />allow them to pass any less restrictive than <br />the State allows. <br />As to ground vibrations - the only thing he <br />could find were in the zoning regulations <br />adopted by the City of Louisville February <br />1976. "Vibration levels should conform to <br />the standards and regulations as set out by <br />the Colorado Department of Public Health's <br />Rules and Regulations." The problem is the <br />Colorado Department of Public Health has never <br />heard of this book; nor has the County of <br />Boulder ever heard of this book. The City <br />must adopt standards whereby they can measure <br />the problems in question, and should involve <br />noise control by recognized standard scienti- <br />fic measurements and ground vibrations.also <br />by scientific measurements, thereby giving <br />everyone a basis to go on. <br /> <br />I want to direct my remarks to Mrs. McDonald. <br />A fella and I carre down here 57z years ago or <br />maybe a little more. I explained the situa- <br />tion at my house, I told them the foundation <br />wasn't any good - it was an old home. One <br />of the old town board members came up and <br />said don't you know that its the railroad - <br />and Mr. Joss failed to mention the railroad, <br />because they want to get away from that. <br /> <br />-8- <br />
