1

DOMENICO'S TESTIMONY CONT'D

MAYOR WASCHAK

. JIM MOTE

That's when they really jarred things. See
they put down in there what they want to.
You see there is a descrepancy there. Now then
over here. Jack Yoblin, president, maintains
that alleged structural damage of buildings in
vicinity is due to other factors besides E. F.
I. activities. This here is the Louisville
Times quote 1/3/76. Yoblin said that represen-
tatives of the State Geological Survey Office and
County Geologist, Tom Gray, had inspected the
house in this area and had determined deterio-
tion due to age, settling of underlying mines
very poor footings, poor construction caused by
the railroad. Now I wanna know them other
factors that is shakLng that property over there;
cause the railroad has a pole barrier on each
side. Well that railroad started in here and
I'm holding you people for that; cause I came
down here for that help that time and never got
it. They just passed it on to the railroad, and
that's all I have to say.

Does E. F. Industries wish to answer Mr. Domenico
in regard to his remarks?

My name is Jim Mote, I am vice-president of E.F.
Industries. Mr. Domenico has essentially called
me a liar again in front of Council, and I would
like to once again clarify the report that was
put together was based on shots that were act-
ually measured. Again I repeat, we do not moni-
tor every shot we make. It is an expensive
proposition. We take readings from time to time
just ro verify that we are with acceptable stan-
dards, and when we are shooting the same charge
time and again, we don't bother to repeat those
measurements. So if he has a time down in his
little day-timer that says a shot went off at
such and such a time and our report doesn't
record that - doesn't mean that we are trying to
hide anything from anyone. We do maintain a log
book, not to the detail Mr. Domenico keeps his
log book. We keep a daily log on the number of
shots made on that day, but we don'tnote the
times. That log book has the amount of explos-
ive that was used on a particular shot on a par-
ticular day, and if there are 5 shots there wil
be 5 entries and it is from that log book you
can determine the size of charge that was shot
off at various times during that day. That log
book is open to examination by Councilor any
of their representatives. Thank you.

-12-
