<br />* <br /> <br />ATTORNEY REPORT CONTID <br />E.F. INDUSTRIES <br /> <br />Attorney Morris stated that he met with <br />Mr. Domenico's attorney, Brendon Morre, <br />and informed him of the reports that the <br />City has received from E. R. Ind., also <br />that Mr. Moore has received copies of the <br />letter sent. <br />Attorney Morris stated that both state and <br />federal agencies that may have made seis- <br />mographic test were contacted and they <br />suggested that the City contact a private <br />firm to do the tests as they could not. <br />The question brought before Council by <br />Mr. Moore was does the City wish to hire <br />a private firm to run tests or obtain <br />the seismographic results and give them <br />to an engineering firm for a report. <br />Councilman McDonald asked if the evidence <br />from a private firm would be sufficient <br />to resolve the problem. <br />Attorney Morris stated that he did not <br />know how conclusive the report will be; <br />however more information will be added for <br />the basing of an opinion. <br />Mr. Brendon Moore stated that if the City <br />does not wish to pursue the problem he <br />will go back to the citizens to get the <br />problem solved. He stated that he felt <br />the City should try to come up with find- <br />ings to get the problem solved. <br />Mr. Moore stated that it was his opinion <br />that E. F. Industries was not coming up <br />with any facts on which they are drawing <br />their conclusions that they are not <br />causing any problems in Louisville. <br />Mr. Wurl asked Mr. Moore if he was aware <br />that E. F. Ind. are willing to submit <br />reports to the City and to Mr. Domenico <br />which are made from sealed cassettes and <br />then can be analyzed by a firm hired by <br />the City. <br />Mr. Moore stated that this procedure would <br />be accepted to give a basic report; how- <br />ever, he stated that he would be reluctant <br />to accept E. F. Ind. statements that they <br />do have controls at the site. He stated <br />that he would have to be convinced that <br />this is reliable data before it would be <br />acceptable as it would be necessary for <br />the reaching of a proper conclusion. <br />Mr. Wurl stated that if agreeable, he felt <br />this would be the best way to start. <br /> <br />Mr. Moore stated that he would like to <br /> <br />-2- <br />
