F. <br />Industries that the tapes are meaning- <br />ful in terms of the tests that have been <br />conducted; the activities that have <br />taken place. He did not want materials <br />that prove what E. F. would like to <br />prove. He stated that if E. F. Industries <br />gives an overall picture of what they <br />are doind and objectives to the degree <br />necessary to protect the citizens he <br />would be willing to have an independent <br />determination as to what it contains; but <br />he did not want the problem delayed. <br />Councilman McDonald stated that she could <br />not understand why the Council was brought <br />into the dispute between the company and <br />a private citizen, and also why the Coun- <br />cil had to be used as an arbitrator <br />between the two. <br />Mr. Moore stated that it was not a dispute <br />between the company and the citizens. <br />The citizens felt that it was a nuisance <br />and that it is the City's responsiblity <br />to take care of its citizens and since <br />the state and federal agencies can not <br />get involved, the City is the agency <br />which should get involved. He stated that <br />he would like to have the problem solved <br />outside of court. <br />Attorney Morris stated that the citizens <br />are stating that the problem is a nuisance <br />within the City and it is the obligation <br />of the City to stop nuisances; therefore, <br />the City should prohibit the cause. <br />Mr. Moore stated that he felt it was more <br />then just structural damage, there is a <br />noise problem along with ground tremors <br />creating a nuisance. Mr. Moore also <br />stated that if a private firm comes up <br />with a report it mayor may not be <br />accepted; as it is possible that the test <br />may not provide certain evidence needed <br />to draw an acceptable conclusion. <br />Mr. Wurl stated that he felt the data <br />that can be obtained from E. F. should <br />be used first and then proceed from there. <br />If this would not give sufficient in- <br />formation to resolve the problem, then <br />the Council should consider going to a <br />private firm. <br />Bruce Joss, attorney representing E. F. <br />Industries, stated that there is some <br />seismographic equipment which is leased <br /> <br />-3- <br />
