POLICE COMMITTEE MEETING cont'd ACCEPTANCE OF POLICE OFFICER - DAVE SMITH Mr. Morris elaborated on the letter stating that the statutes now read that the authority of appointment can be delegated instead of Council appointing as presently done. Attorney Morris also stated that the City Ordinance now states that the appointing will be done by Council, and that if Council wishes to delegate the authority to others, he felt the City ordinance should be amended accordingly. Attorney Morris also stated that the ordinance could remain the same and still comply with the State Statutes. Mr. Wurl recommended that the appointment be delegated to department heads because he felt that if a person is appointed by Council then the department head should not be held responsible for the employee. After discussion Councilwoman Dhieux moved that the City Attorney draw up an ordinance to conform with the state law on the se- lection of police officers for the City. Seconded by Councilman Domenico. Roll call. Domenico yes, Berry no, Dhieux yes, DelPizzo no, DiCarlo no. Motion defeated. Councilman DiCarlo requested that Council and City staff review the procedure now in force and plan a work session. Mr. Wurl stated that the staff would work up a recommendation and present it to Coun- cil for discussion. Chief Munger presented Council with three applications to fill the vacancy by Officer Robert Nelson. The qualifications of each applicant were presented to Council along with Chief Munger recommendation to appoint David Smith to fill the vacancy. The other two choices were: D. Britt Wurl and Gordon Madonna. Council asked Chief Munger about Mr. Smiths schooling. Chief Munger stated that Mr. Smith was attending Metro State College study law enforcement. After dis- cussion, Councilwoman Dhieux moved that Dave Smith to hired to fill the vacancy in the Police force. Seconded by Councilman DiCarlo. Roll call. Domenico yes, Berry yes, Dhieux yes, DelPizzo yes, DiCarlo no. Motion carried. Officer Smith will be pre- sented to Council at the October 21, meeting. Officer SMith will begin work effective October 10, 1975, starting salary $640/month. 5.
