CITY ATTORNEY REPORT cont'd

ORDINANCE 1f4lJ.2
LOUISVILLE WEST ANNEXATION
PUBLIC HEARING cont'd

-It.-

Attorney Morris stated that it was
Sprouls request to continue the matter
for about one year.
Steve Sproul representing the developers
gave a brief talk in regards to the
land which was to be annexed and stated
that the boundaries have been changed
as to the area which they would want
annexed first. He stated that he would
go with which ever way Council felt
would be the best. Mr. Sproul stated
that the land which ,,vould be developed
over a length of time would be for
agricultural use.

Councilman Berry stated that he had lost
some faith in the Sproul development.
He stated that he had not seen an
annexation agreement and felt this
should have been taken care of in the
early parts of the annexation procedure.

Councilman DelPizzo stated thtt he too
fel t an annexatLm agreerC1ent should have
been presented, and he felt Fred Sproul
should have corne to some ~eetings to
discuss the plans instead of sending
everyone else. Councilr,an DelPi.zzo
stat~d that he felt the request should
be withdrawn and the developers come
back when thev have the i-Thole plan
ready for dis~ussion and to woik on.

Councilman DiCarlo stated that he felt
the City did there part on the annexation
and he felt Sproul should have COF'.e
up with the agreement and tried to get
the matter resolved instead of carrying
it out so long.

Councilwoman Dhieux asked if she was
correct in saying that Sproul would
like to keep the petition alive until
the matter could be settled. Mr. Sproul
stated that this was basically correct.

Attorney Nor..:-is stated that he had
talked wi. th l'1r. Sproul who asked that
if they withdrew the annexation petition
if a full annexation fee could be altered
since much of the study has been completed.

Councilwoman Scholl stated that she felt
at the time of repetition it would have
to be decided upon as to just how much
more work will have to be done and that
the full annexation fee may be needed again.
Also, she agreed ,,,,ith the previous Council

comments.
