• res -1pp ag age 2 SOLAR HEATING Councilman DelPizzo asked what percent of CONTINUED heat the system would supply and what guar- antee there was that the systme would work. Mr. Drumm stated that there wasn't any sure guarantee and the percentage of heating would be approximately 37%. After comments Councilman Kilker moved that the matter be postponed with the permission from the Parks & Rec Board until further in- formation is given. Seconded by Councilman Caranci. Roll call vote. Caranci yes, Meier yes, DiCarlo no. DelPizzo yes, Kilker yes. Motion carried. AUDIENCE COMMENTS There were no comments from the audience. CITY ATTORNEY REPORT ANNEXATION HEARING Attorney Joss stated that a hearing must be held by Council on the request to annex, to determine if the annexation is possible, the reason being that there is a parcel of land that is included in the area to be annexed, however, the owner is not petitioning for annexation, the property being owned by Court Square Investment Corporation is .77 acres. Mr. Joss stated that Resolution #19 setting out for a need for a public hearing stated that it was properly published. Attorney Joss presented evidence regarding the proposed annexation. Exhibit A - Annexation petition and a letter requesting annexation from the property owners; Ebers , Daniloff, Foster, King and Santilli. City Planner Drumm presented evidence also. ~ Exhibit H - Annexation map to the City of Louisville stating that the 1/6 contiguity is applied. Exhibit C - Louisville Comprehensive Plan which' shows the proposed area included within the City of Louisville. He also supplied the criteria that was pre- sented in Resolution X23 . Mr. Drumm also stated that the Planning Commission held a hearing on the proposed annexation and zoning and recomded to Council that they approve the annexation request.
