411 410
•
10/19/82 Page -13-
Councilman Leary Inquired - in the comp plan, what kind of
policies or criteria do we have of what our
high density needs are presently?
Rupp advised both the uses - the office use
and the high density are needs that the com-
munity have identified as being desirable.
It was his understanding that the medical
group had a very definite need to locate
at this location, as a group and want to
expand the specialities for the City of Louis-
ville with a wider range of professional medi-
cal doctors to provide service to the community.
Rupp advised that high density areas are
also proposed in the Centennial Valley overall
master plan.
Councilman Leary Inquired if Council would be allowed to review
the South Boulder Road access again.
Rupp advised that the developer is aware this
will be addressed again.
Question called for on the motion. All in
favor. Motion carried unanimously.
KOSHIER BURRITO REPORT Attorney Rautenstraus advised complaints had
been voiced regarding the entertainment , and
whether that had altered the use requirement.
Mayor and Council had been provided with a
copy of the letter sent to the owners of the
Koshier Burrito stating that the issue was
being reviewed with their non-conforming use.
Rautenstraus and other members of staff had a
meeting with the owners , who stated they would
reply in writing, and appear before council
at any time they were requested to do so to
discuss the matter further. The issue is
if the entertainment which they do provide
is only an accessory to the restaurant use;
if it becomes more than an accessory to the
restaurant this would be an extention of the
non-conforming use and would not be allowed. .
This is the information that is requested
from the owners and a further review of staff
of the complaints .
Councilman Ferrera Inquired if they have music when food is being
served.
Attorney Rautenstraus advised this is an issue
we wish clarified from the owners. It was his
feeling that they did not have the entire res-
trauant menu for the entire period of time that
they have the music .
